<br />RESOLUTION OF THE BOARD OF PUBLIC WORM AND SAFETY OF THE CITY OF
<br />SOUTH BEND, INDIANA.. DIRECTING EXECUTION OF C ONTRACT ';KITH CHICAGO
<br />SOUTH SHORE AND SOUTH BEND RAILROAD
<br />WHEREAS, on the 29th day of May, 1939, the Board of Public (forks and Safety of the
<br />City of South Bend, in St. Joseph County, Indiana, at a meeting of said Board of Public
<br />Works and Safety, did determine the exact form in which a franchise, grant`dhd contract.
<br />to and with Chicago South Shore and South Bend Railroad, to locate, construct, maintain
<br />and operate an industrial spur railroad track across an a lley in said City,. was to be
<br />finally adopted, and fixed the 19th day of June, 1939, at the hour of nine'ofelock,A.M.
<br />at the regular meeting 'place of said Board of. Public Works and Safety in the _ Cit#` Hall
<br />in said City of South Bend as the time and place at which said franchise, grant azd •
<br />contract was to be finally considered by said Board of PublieWorks and Safety; and
<br />AREAS, proof of publication of the full and complete text of the said proposed
<br />franchise, grant and contract in the South Bend Tribune, on the lst day of June, 1939,
<br />and in the South Bend Mirror on the 2nd,day of June, 1939, being two newspapers of gener
<br />al circulation printed in the English language insaid City of South Bend, St.Joseph
<br />County, Indiana, and proof of the posting of notice of the full and complete text of
<br />said proposed franchise, grant and contract in more than ten public places within the
<br />said City of South Bend, on the 2nd day of June, 1939, have been duly made, and all the
<br />terms and provisions of the statutes of the State of Indiana have been fully complied
<br />with; and
<br />WHEREAS, at this meeting of the Board of Public Works and Safety of the City of •
<br />South Bend, held on the 19th day of June, 1939, cor encing at the hour of nine o'clock,
<br />A.M., a public hearing was had on said franchise, grant and.contract; and no taxpayer
<br />of the City of South Bend has appeared and filed protest against any of the provisions
<br />of said franchise, grant and contract; 9
<br />IT IS THEREFORE, now on motion made and seconded,
<br />RESOLVED, that the Board of Public Works and Safety of the City of South Bend, now
<br />enter into, make and execute the said franchise, grant and contract to and with the
<br />Chicago South Shore and South Bend Railroad in the manner and form proposed by this
<br />Board of Public Works and Safety at its meeting on the 29th day of May, 1939, as it ap-
<br />pears in the records of said meeting.

<br />vThe following deed was accepted and was recorded in accordance with t he minutes of
<br />the meeting of February 6, 1939;
<br />✓Deed of George F. Goss and Zora B. Goss, husband and wife to the City of SouthBend
<br />for the following described real estate: to -wit:
<br />Twenty-seven (27) feet off e.f and from the entire east end of a
<br />tract of land described as follows:
<br />A tract or parcel of land bounded by a line running as follows: •
<br />viz Beginning at a point in the North and South center line of
<br />Section numbered Thirty-three (33) Township Numbered Thirty-eight
<br />(38) North of Range Numbered Two (2) East, distant South Nineteen
<br />Hundred and Sixteen (1916) feet from'a stone in the cebter of said
<br />Section, thence East Six Hundred and Twenty-seven (627) feet, -

<br />The above conveyance is made for the purpose of widening of Illinois •
<br />Street in the City of South Bend, Indiana.
<br />which Quit -Claim Deed was recorded in Book No. 312 at page 222 and is Document No.62569
<br />in the Records of the Recorder of St.Joseph County, Indiana, and is Document No.. 712 in
<br />the Records of the Board of P,,blic Works and Safety of the city of South Bend, Indiana.
<br />/Jarvis L. Gamble of 214 W. Navarre Street presented a claim to the Board of Public
<br />Works for damages resulting from alleged defect in sidewalk and curb at 307 South
<br />Franklin Street. The matter was referred to the City Attorney.
<br />STREET LIGHTING: Mr. Qualls was present and matters pertaining to his department were � •
<br />discussezi. Mr. Qualls was instructed to prepare an analysis of the street lighting
<br />system and also to assemble information needed in advertising for bids on t he contract
<br />fOr street lighting.
