---------- ---------------------- <br />AGR.EEM ENT — <br />THIS AGREMENT made and entered into between the - - <br />Municipal City of South Bend, Indiana, by its Board of Public Idorks <br />and Safety ..and Sam Berman <br />W ITNESSETH: That <br />KHMIEAS, the City of..South Bend is the owner of the iron <br />rails now constituting the street car tracks on'Sample Street between <br />Chapin and Walnuts Streets, and <br />NHEIRL'A5, said City is desirous of removing said tracks and <br />disposing of said rails, and <br />V�MRFFAS, said street is to be repaved by the TI orks Progress <br />Administration, and it is necessary to remove said rails before said <br />repaving can be accomplished, <br />IT IS, TITTREFORE, agreed by and between the parties that <br />Sari Berman hereby purchases <br />from the City, said rails for the consideration of 250.00 , <br />the receipt of which is hereby acknowledged,aad it is --:understood and <br />agreed by and between the parties that said rails=will be removed by <br />SM1 Berman under the <br />supervision of and in accordance with the instructions of the City of <br />South Bend, and will be removed at such time as will accommodate and not <br />interfere with the work being done by the Works Progress Administration <br />in repaving said Sample Street. In the event Sari Berman <br />fails to remove said rails <br />without interference with the_vork of repaving said street, then the City <br />may, at its discretion, remove said rails and as compensation for said <br />removal, re-sell.the same or such part thereof as it may be required to <br />remove, to any one that it sees fit and in such event, Sam Bermm <br />shall have no claim a.-ainst the <br />City of South Bend for any damages or breach of contract as the result of <br />such removal and re -sale. <br />IN - ITNI�3S 1^j-i-1h-REOF the parties hereto have set their hands <br />this 23rd day of Yarch, 1939. <br />I:`UNICIPAL CITY' OF SOUT-H .
