MEETING OC TOBER 28 , 19 35 Regular meeting of the Board of Public Works was held at 11:00 o'clock. All members were present. Minutes of previous meeting were read and approved. The Board advised him that investigation would be made to ascertain if -it would be practical and if sufficient funds are available. t Representatives of plumbers of the City of South Bend who requested the Common Council to amend Ordinance 2525, which was referred to the Board of Public Works, were .;present to urge the Board to introduce this Amendment and, after a thorough discussion of the matter, 11, Anderson, City Civil Engineer, stated he would go over the points i and amend them with the City Attorney and arrange for the introduction of the Amendment. �iThe Amendment, as requested by the plumbers, is as follows: To Amend Ordinance No. 2525 An Ordinance authorizing Board of Public Works to include in all Contracts for permanent improvements the installation of sewer, water, gas, wire and other connections. Be it ordained by the Common Council of the City of South Bend, Indiana: Section 1. That whenever the Board of Public Works shall desire to improve any street, alley, or other public place by paving the same and shall further desire to adopt an improvement resolution to that effect, said Board is hereby authorized to include in said improvement resolution the installation of sewer, water, gas, wire and other connections as may be deemed necessary to accommodate the abutting property along said street, alley, or public place; also, such improvement resolution shall have affixed thereto the necessary plans and specifications designating the material to be, used in such sewer, water, gas, wire and other connections, the number and location thereof, and the manner of laying the same from the main to a point inside the curb line. PROVIDED HOWEVER That this Ordinance shall not prevent any owner of any such abutting property from making such connections and installations if he make and complete the same in accordance with the plans and specifications for such connections and install- ations as designated by said Board and within twenty (20) days from the date of the Confirmation of such Resolution. Section II. The cost of making; such connections by said Board shall be considered a part of the cost of the permanent improvement project and shall be so assessed against such abutting properties as are benefited. Section III. All Ordinances heretofore passed by the Common Council of said City that are in conflict herewith are hereby repealed. Section IV. Whereas an emergency exists for the i=nediate`taking effect of this Ordinance, the same shall be in force from and after its passage and legal publication. Wm. E. Rasmussen, Councl-Iman 5th Dist. We, the undersigned, petition your honorable body to amend this Ordinance, striking out the water connections mentioned in Section I., and further amending by adding section to said Ordinance requiring that all water connections under each contract be let separately after advertising for competitive bids by the licensed master plumbers entitled to bid. thereon, under the Ordinances of the City of South Bend, Indiana. Mr. Charles Lewinski and Mr. Sroda again appeared before the Board with reference to his property at Western Avenue and Walnut Street and requested some relief. The Board again advised them that the only method of relief would be to file a suit in the Courts as there was no way in which the Board could offer relief. A communication was received from Dillon J. Patterson claiming damage to his automobile in the amount of $2.90, due. to what he claims was negligence on the part of the Street Department in leaving a bad pavement on Lincoln Way East.opposite Playland Park.
