Street in the City of South Bend as now located, described as follows: Measuring from a point at the intersection of the property lines of LaSalle Ave. and Lincoln Way West, a distance of 131.32, feet West on the North property line of LaSalle Ave., to the Southeast corner of Lot (B) . Beginning at this point, the Southeast corner of said Lot (B), thence running West on the North prrperty line of LaSalle: Ave., a distance of 71.50 feet to the Southwest corner of said Lot (B) , . thence North 90 deg. 1« Nest, a distance of 54.05 feet., thence North 152 deg. 25' East, a distance of 47.32 feet, to the South property line of Lincoln Way Test and the northwest corner of said Lot (B), thence South 89 Deg. 401 East on the South property line of Lincoln Way West a distance of 77.30 feet to the northeast corner of said Lot (B), thence South 90 deg. Parcel C Lot C of Bank Out Lot Numbered One (1) of the first plat of Out Lots of the Town, now City of South .send, platted by the State Bank of Indiana, that lies East of the East line of William St. in the City of South Bend as noW located, described as follows: Beginning at the Southeast corner of the intersection of the property lines of Lincoln Way West and William St., which point is 263.07 feet frem the intersections of property lines of Lincoln Way West and LaSalle Ave. , thence running Southeasterly on the South line of Lincoln Way West a distance of 50,50 feet to the Northeast corner of Lot (C) , thence South 90 Deg.201 West a distance of 51.45 feet to the Southeast corner of said Lot (C), thence North 103 Deg.--431 West a distance of 49.56, feet to the East line of William St.,, thence North 76 Deg. 38 t East a distance of 10.60 feet, thence Northeasterly a distance of 51.97 feet to the place of beginning. Your petitioner farther shows that the assessments as hereinafter set forth have divided said real estate into two parcels, four assessments of which cover entire Parcel A, and a small portion of Parcel B, and that five assessments cover all of Parcel. C and all of Lot B, excepting a small portion which is covered by Parcel A. Your petitioner in order to be of assistance to your Honorable Board of Works in the -respread,and reassessment of said unpaid and delinquent improvement assessments, suggests that the assessments as set forth in Exhibits B, C, D and E, which assess- ments cover all Cr Parcel A and a small porti cm of Parcel B, be changed to corer the descripticar_ of Parcel A, and that the assessments delinquent, unpaid and undue as set forth in Exhibits F. C, H, I and J, which assessments cover all of Parcel C as set forth in said blue print and said description hereinbefore set out, and all of Parcel B, excepting a small par ti on, be divided sixty (60) percent on Parcel B as hereinbefore described, and forty (40) percent thereof on Parcel C as herein - before described. Your pe titi oner furthe r states t mat . it has now an opportunity to sell Parcel C and Parcel A. and that in the sale it is contemplated to pay the assessments in full, which would leave only the assessments on Parcel B not fully paid; that it is impo- ssible to sell said real estate without having.said assessments respread and re- assessed according to the descriptions as hereinbefore set out in the survey and blue print hereto attached. WHEREFORE, your petiticner requests your Honorable Board to reassess the unpaid amounts of the improvement assessments as set forth in the exhibits as hereto atta- ched and respread them as suggested herein or else as determined by your Board, so that -each parcel shall bear its equitable and fair portion of the unpaid assessments and all interest thereon and all penalties and costs.
