That notice of said improvement was sent to the <br />said Ralph Jones, and your petitioner, who inherited said real estate from his said <br />fether, Samuel Whitehall, never received notice of said improvement; that said improve -I., <br />ment was not waivered and. there is now due on said improvement the sum of five hundred I <br />Ninety-five and 85/100 I)ollers (595.85). <br />Your petitioner would further shod that Credd Jarett is the purchaser under land <br />contract from this petitioner of the following <br />described, Real Kstate, situate in said. <br />City, county and State, to -wit: <br />Beginninp on the test line of F lcon Street in the City of South bemd at a point <br />one hundred twenty (120) feet North of the North line of `«ashington Street,, in said <br />Uity; thence East one hundred twenty-nine (129) feet; thence North forty (40) feet-'i <br />thence Viest one hundred twenty-nine (129) feet; thence South forty (40) feet to be- <br />ginning, and being the North forty (40) feet of the Oouth one hundred sixty (lc)o) <br />feet of Lot Numbered Ten hundred -tiFhty Six (1086) as shown on a proposed, plat of <br />LaSalle Park. <br />Your petitioner would further show that said improvement assessments above de- <br />scribed are a lien against said real estate; that the said Creed Jarett has applied <br />for a loan through home Owners Loan Corporation to pay off said contract; that in <br />order to secure said loan all assessment for public improvement now due or past due <br />must be paid; that said home Owners Loan Corporation will pay said assessments now <br />due or past due levied against the above described Real Estate. <br />Your petitioner would further show that the City Treasurer is unable to separate <br />and. divide the assessments for public improvement hereinbefore mentioned so that the <br />amount due against the above described Real Estate may be determined. <br />*Wherefore, your petitioner prays that an order be entered directing the City 11• <br />Engineer, together <br />_ether with the City Controller, to respread said assessments so that the <br />amount due afrainst said lest described Real Estate will epprea of record, and for <br />all other relief right and -proper. <br />Frank E.
