Tuesday, Jpnuery bth., 1932. <br />In the aoove reamed assessment roll, Lucy �Dtegmann, owner of lot No.l in <br />Wenger's 1st.., Addition, withdrew all ob j ed.tions regaraing said vacation and the <br />board., after hearing all per. sons interested in said roll and being fully advised in <br />the premises, the;_;severe 1 lots and parcels; o f land have been benefited and <br />damaged in tij e amounts shown on said roll. The board , therefore, takes final action on <br />said assessment roll and declares same in all things ratified, confi rme d and approved <br />without modification and the street vacated and all proceedings had with reference to <br />said vacation Resolution A0.2463 are hereby sustained and the proceedings closed. <br />pity yngineer, H. Peter 6treet from Almond Court .to South Bend Avenue under <br />acation Resolution No.2422. <br />In the above named assessment zo ll , the board,, here try orders that on the <br />26th. , day or- -January, 1962, this board will meet in their office in the City Hall <br />at 10:00 A. M* , to hear anci receive remonstrances i'rom all persons Whose property <br />has been aVrectea by said vacation and will decide uhether the several lots and <br />parcels of land have been, or will be bendfited bn damaged in the amounts shown on <br />saia roll or in a greater or less sum than that shown on said roll. The Board further <br />orders that notices or said nearing together with the amounts of damages awarded and <br />benefits assessed, be delivered to property owners according to law. <br />The following contract was presented to the board by Charles B. Calvert, <br />of the Indiana. and Michigan Electric Company and was signed by the Board: <br />CONTRACT AND SPECIFICATION FOR ELECTRIC ENERGY FOR <br />LIGHTING PUBLIC BUILDINGS OF SOUTH BMTD, INDIMA. <br />THIS AGREEP;V"VNT, made and entered into this bth. , day of January, 1932, by <br />and between Indiana & Michigan. Electric Company, a. corporation pf the State of Indiana, <br />hereinafter sometimes called the 'Company and the City of South Bend a municipal <br />corporation, by aihci tiil=ougrL its board of Public Itiorks� me <br />hereinafter sometimes called <br />the "Customers, <br />W I T N E S S E T H <br />That for a.nd in consideration or the mutual covenants and agi°eements herein- <br />after contained, parties hereto agree with each other as i'ollows :- <br />1. The Company shall furnish Customer and the Customer take and pay for as <br />hereinafter provided, for and during the term of this contract (but with the restrict- <br />ion .that the Customer will not resell or distribute the electric energy hereby contract- <br />ed for) all of the electric energy cf the character hereinafter specified which shall <br />be required by the Customer for light and power purposes at the public building listed � in"Schedule A" hereto attached and made a part hereof. <br />2. The Company aiall furnish anti the Customer shall take and pay for electric! <br />energy iiereunder for and during ttie period beginning on January 1st., 1932, and ending <br />December 31st., 1932 and thereafter in successive periods of not less than one (1) year <br />each until either party shall give the other not less than sixty (60 ) days notice in j writing of its election to discontinue the service at -the expiration of any said speci- <br />fied periods. <br />3. The electric energy delivered hereunder small be in the firm of single <br />phase, sixty cycle, alternating current at commercial voltage for lighting and in the form of three phase, sixty cycle, alternating current at commercial voltage for power <br />and shall ce delivered and metered at the raeter or meters installed anti owned by the <br />Company at each of said public buildings, which points shall be known as "Points of <br />Delivery" of such electric energy. <br />All such electrical energy shall be delivered at a reasonable close mainten- <br />ance of constant potential and frequency arm. shall be measured at c.omiiercial voltage at <br />the points of delivery. <br />The Company, snail provide and install in a. suitable place to be pmvided <br />therefor by the Customer at the Points of Delivery or such energy, suitable standanrd <br />I' integrating watthour• meters to neasule the energy delivered to the Customer/ <br />4.
