Therefore, Ms. Dorau made a motion <br />recommending approval of the request for vacation. Mr. Mueller seconded the motion which <br />carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE SOUTH ST. JOSEPH <br />STREET WHERE IT DEAD -ENDS AT THE FORMER K-MART <br />Mr. Gilot indicated that Menard, Inc., 4640 S. Michigan Street, South Bend, IN 46614, has <br />submitted a request to vacate the above referenced street. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Police Department, Fire Department, Solid Waste, Community Investment, Streets <br />and Engineering. Area Plan stated the vacation would not hinder the growth or orderly <br />development of the unit or neighborhood in which it is located or to which it is contiguous. The <br />vacation would not make access to the lands of the aggrieved person by means of public way <br />difficult or inconvenient. The vacation would not hinder the public's access to a church, school <br />or other public building or place. The vacation would not hinder the use of a public right-of-way <br />by the neighborhood in which it is located or to which it is contiguous. Therefore, Ms. Dorau <br />made a motion recommending approval of the request for vacation. Mr. Mueller seconded the <br />motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST <br />NORTH/SOUTH ALLEY EAST OF FRANCES STREET, BETWEEN WESTERN AVENUE <br />ON THE NORTH AND RUNNING SOUTH OF 198 FEET, MORE OR LESS TO THE FIRST <br />EAST/WEST ALLEY SOUTH OF WESTERN AVENUE AND TO VACATE WESTERN <br />AVENUE FROM FRANCES STREET RUNNING EAST 175 FEET MORE OR LESS <br />Mr. Gilot indicated that Danch, Hamer & Associates, 1643 Commerce Drive, South Bend, IN <br />46628, has submitted a request to vacate the above referenced street and alley on behalf of their <br />client, The Robert Henry Corporation, 404 S. Frances Street, South Bend, Indiana. Also <br />submitted with his letter were two (2) ingress/egress easement documents from two (2) parties <br />with garage access on the alley. The Corporate Attorney for the Robert Henry Corporation <br />obtained signatures from the affected property owners, Martin and Jose Cuellar, 411 Parry St. <br />and Matthew Sisk and Jennifer Henecke, 415 Parry Street, and recorded the easement documents <br />to allow for continued access to the vacated alley to the west to Parry Street. Mr. Gilot advised <br />the Board is in receipt of favorable recommendations concerning this Vacation Petition from the <br />Area Plan Commission, Fire Department, Solid Waste, Community Investment and Engineering <br />subject to the easement access agreements. Therefore, Ms. Dorau made a motion recommending <br />approval of the request for vacation. Mr. Mueller seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Dorau, seconded by Mr. Mueller and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATION: 137 Sadie Street <br />REMARKS: All criteria has been met <br />NEW INSTALLATION: Fourteen (14) Residential Parking by Permit Only Spaces <br />LOCATION: South Side of East Colfax Avenue between Sycamore <br />Street and the East Race <br />REMARKS: All criteria has been met <br />NEW INSTALLATION & REMOVAL <br />DESCRIPTION: New Installation of All Way Stop Sign and Removal of <br />Traffic Signal <br />LOCATION: Colfax Avenue and LaPorte Avenue <br />REMARKS: All criteria has been met <br />REVISION: Temporary Bus Parking <br />DESCRIPTION: 200 Block of Main Street, West Side from LaSalle Avenue <br />to the East/West Alley <br />LOCATION: Temporary Bus Parking for Events at the Morris <br />Performing Arts Center <br />
