Olive Street <br />Dorau/Mueller <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — HIBBERD REALTY <br />INC. — ALLEYS NORTH AND WEST OF 1329 E. WASHINGTON STREET <br />Mr. Gilot stated an application for a Revocable Permit has been received for the purpose of <br />allowing the installation of new pavement and pavers to be installed in the alley and renovation <br />of egress basement windows, bollards, and pavers in the alley at 1329 E. Washington Street. The <br />Board noted the alley is a public alley and the encroachment must not block access to the public. <br />Therefore, upon a motion made by Ms. Dorau, seconded by Mr. Mueller and carried, the <br />Revocable Permit was approved subject to the protective bollards allowing 12' clear public <br />access in the alley and not blocking the alley. <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — HORIZON AWNING. <br />LLC — 3024 E. MISHAWAKA AVENUE <br />Mr. Gilot stated an application for a Revocable Permit has been received for the purpose of <br />allowing the installation of a fabric awning at 3024 E. Mishawaka Avenue. The Building <br />Department stated a Building Permit is required if this is just an awning, and if there is <br />advertising placed on the awning, a Sign Permit is required. The encroachment shall remain in <br />the right of way until the time as the Board of Public Works of the City of South Bend shall <br />determine that such encroachment is in any way impairing or interfering with the highway or <br />with the free and same flow of traffic. Upon a motion made by Ms. Dorau, seconded by Mr. <br />Mueller and carried, the Revocable Permit was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE EAST/WEST ALLEY <br />14' IN WIDTH AND APPROXIMATELY 120' LONG FROM EAST RIGHT-OF-WAY OF <br />EMERSON STREET AND EAST RIGHT-OF-WAY OF NORTH/SOUTH ALLEY BETWEEN <br />NORTHSIDE BOULEVARD AND HILDRETH STREET <br />Mr. Gilot indicated that Mr. Murray Miller, on behalf of the St. Joseph County Building Trades, <br />1345 Northside Blvd., South Bend, IN 46615, has submitted a request to vacate the above <br />referenced alley. Mr. Gilot advised the Board is in receipt of favorable recommendations <br />concerning this Vacation Petition from the Area Plan Commission, Fire Department, Solid <br />Waste, Community Investment, Streets and Engineering Department. Area Plan and Community <br />Investment stated the vacation would not hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous. The vacation would not make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient.
