h <br />That it is necessary for side track facilities to be maintained to said <br />gravel pit, _ <br />I <br />That the Chicago, South Shore and South Bend Railroad is the only railroad <br />accessible to - said gravel pit; <br />�I <br />That it will be necessary for the -Chicago, South Shore and uouth Bend <br />Railroad to construct a temporary side track to the west of its present side track <br />if said gravel pit is to be served by thin Railroad; <br />That in the location of the temporary side track west of the present <br />side track it will be necessary to construct such temporary side track upon and <br />across Crumstown Road and Nancy Street by a route, the center line of which is <br />approximately as follows: <br />"Beginning at a point do the southerly line of Crumstown Road, which <br />point is sixteen and seventy -love hundredths.. (I6.75) feet west, measured at right <br />angles to the west line of Secti on Three (3) Township Thirty Seven (37) North; <br />Range Two (2) East, in the City of South Bend, County of ,k,- Joseph, State of Indiana; <br />thence northwardly approximately forty (40) feet to the. northerly line of Crumstown <br />Road; thence by a curve to the right having a radius of seven hundred sixteen and <br />twenty-f6ve hundredths (7I6.25) feet a distance of approximately one hundred eighty <br />(ISO) feet , to the nest line of a strip of lard owned by the Chicago,Mouth Shore and <br />South Bend Railroad;" <br />That if your Honorable Board sees fit to grant the temporary permit herein <br />sou#ht, the Chicago, South Shore and South Bend •-Lailroad agrees: <br />that the trolley wires used in connection with said track shall be suspended <br />a# a height of not less that eighteen "and one-half (IS*) feet above the rails of said,; <br />track; <br />That said trolley wires shall be suspended from span wires, cross arms, <br />or supports attached to substantial wood poles; <br />That it will hold harmless said City from all damages,, costs and expenses <br />which said City shall be compelled to pay as a result of any default, carelessness <br />or neglect of the RailRoad in -the construction, maintenance and operation of its <br />said temporary side track on and across said streets, provided, however, that said <br />jity shall tromptly notify said Railroad pf any suit brought against said City; <br />That the Railroad will discontinue the use of said temporary side track <br />as soon as arrangements can be made for the loeati on of Us permanent track across <br />said streets. <br />Wherefore the Chicago., South Shore and South Berl Ra ilr oad respectfully i! <br />prays. your Ho#orable Board that it be permitted to construct and maintain, in the <br />manner herein set forth, a temporary side track over the route described herein <br />and upon the conditions set out. <br />signed CHIC A GO SOUTH SHORE ORE AND SOUTH BEND RA MROAD <br />By W.
