<br />8. The Contractor shall have t'r e right with the consent of the Board of
<br />Public ''forks of the City, at any time during the life of this contract to install,
<br />operate and maintain in the place of the lamps herein provided for-,. and under the
<br />same terms and conditions, other and more improved lames in 'peeping with such advance
<br />ment as may be made in the art of lighting, which lamps shall be of equivalent or
<br />greater illuminating power.
<br />9. In authorizing ar granting a permit to any person, firm or corporation
<br />to .repair or cut into any street alley, or sideway-c in which said street lighting
<br />units and lines and cables supplying cars-nt thereto are located, the City shall
<br />require as a condition to the granting of such permit, an agreemtn on the part of
<br />the applicant that such lines and cables and street lightning units will not be inter-
<br />ferred Trrith in any manner without notice to the Contractor.

<br />10.1 All the covenants, expressions, terms, conditions, provisions and
<br />agreements herein shall extend to and be binding upon, or inure to the benefit of,
<br />as the case malr be, each and every one of the successors or assigns of each of the
<br />parties hereto as if in every case so expressed.
<br />II. This contract shall be in force and effect for a period terminating
<br />with the termination of the =eneral Contract for street lighting, which termination •
<br />date is January I, 1935, at noon.
<br />In witness whereof, the said City of South Bend, Indiana, has caused its
<br />corporate seal to heremnto affixed and this contract to be signed by the Board of
<br />Public Works of said City and said Indiana & I-Tichigan Tlectric Company has caused
<br />this contract to be duly execated , in duplicate, this day and y-ar first above '

<br />The Board approved the Final Estimate for the heavy traffic concrete rave-
<br />1; ment improvement on Foster Street to Foward Street to St. Vincent Street in accord-
<br />ance with the terms of the contract between the City and Hoban Pr Roach, contractors,
<br />I' under improvement Resolution No.2247, in the amount of '"5,084.9I.
<br />Day roll claims in the amount of 79,027.96 for various departments were
<br />signed and approved by the Board.
<br />The Board also approved a pay roll claim for the Trigineering Department
<br />in the amount of I32.00 and h-reby orders the City Controller to pay same out of
<br />Trac'c Mevation fund.
<br />Claims in the amount of 13,599.93 for various departments were s-tgned and
<br />approved by the Board.
<br />This being the date set, the following proposals were received, opened and
<br />read for the Collection and Disposal of Garbage and for the Disposal Only of Garbage
<br />in the City of South Bend, Indiana.
