REGULAR MEETING <br />Upon a motion by Mr. BonDurant, seconded by Ms. Vasquez and carried, the following Resolution <br />was approved by the Board of Public Safety: <br />RESOLUTION NO. 61-2009 <br />A RESOLUTION OF THE BOARD OF PUBLIC SAFETY REORGANIZING THE <br />RANKS OF THE SOUTH BEND POLICE DEPARTMENT <br />WHEREAS, in the months of June through September, 2009, the Board of Public Safety <br />through its appointed agent, Charles Leone, and other members of the City's Advisory Negotiating <br />Team negotiated a new one year ng wage package and Working Agreement with the Fraternal Order of <br />4D tl Zn <br />Police Lodge No. 36, the representative of the sworn members of South Bend Police Department <br />excluding the ranks of Captain and above; and <br />WHEREAS, during the negotiations the parties agreed that there should be a restructuring of <br />the ranks so that eventually the highest non-supervisory rank in the South Bend Police Department <br />will be Patrolman First Class and the rank of Corporal will be phased out; and <br />WHEREAS, the financial constraints upon the City at this time require that this full <br />restructuring take place over a number of years but that the intent is to benefit pensioners and not to <br />provide an interim windfall raise to some current sworn members; and <br />WHEREAS, the Board of Public Safety is the appropriate body pursuant to its powers under <br />LC. 36-8-3 to restructure the ranks of the South Bend Police Department, and to create job <br />descriptions and promotion requirements for the ranks within the South Bend Police Department. <br />NOW, THEREFORE, THE BOARD OF PUBLIC SAFETY, makes the following changes in <br />the rank structure of the South Bend Police Department to be effective at 12:00 midnight, January 1, <br />2010: <br />1. The rank of Entry Level Officer shall be abolished and any sworn members holding <br />that position shall be assigned the rank of Third Class Police Officer; <br />1 Every sworn member, including those who currently hold the rank of Entry Level <br />zn <br />Officer, shall be assigned to and shall hold the rank of Third Class Police Officer until the end of <br />his/her probationary year; <br />3. The rank of Second Class Police Officer is created. A sworn member shall become a <br />Second Class Police Officer upon the completion of his/her probationary year; and <br />4. All sworn members who hold the rank of First Class Police Officer or First Class <br />Patrolman on December 31, 2009 shall be reassigned at the beginning of the new year to the rank of <br />Second Class Police Officers, which reassignment shall not involve any change of pay or of benefits. <br />6, Any police officer sworn in after this date shall be eligible for promotion to First <br />Class Police Officer after the five years of service and a recommendation from the Chief of Police <br />that the sworn member has completed five years in a satisfactory manner. <br />7. The rank structure of the South Bend Police Department shall not be otherwise <br />changed by this Resolution. <br />8.
