10 <br />ASAP Towing & Recovery as well as all employees of the company agree not to assign its rights, under this contract, to <br />any other person or entity without prior written notice and consent from the City of South Bend. The company and all of <br />its employees understand that any such assignment could constitute a breach of contract. <br />The company shall, at all times, maintain separate and accurate records in connection with the storage and removal <br />services it provides the City and shall make all records available to the City upon request. <br />Records to be maintained shall include the following: <br />a. Time, date, location of tow, and officer authorizing the tow; <br />b. Make, model, vehicle license registration, and VIN number of towed vehicles; <br />c, Itemized billing of basic tow charges, special charges, storage charges, and any special vehicle repair/care <br />charges, i.e. window wrap, key charge, etc.; <br />d. Signed release form by person claiming the vehicle; <br />e. If applicable, complaint form, signed by the vehicle owner reporting any complaints regarding charges, vehicle <br />damage, lost or stolen items from the vehicle, or any other related problems. <br />® Customer complaint forms will be posted in the office in a clearly marked space. <br />® All customer complaints will be mailed to the South Bend Police Department within five days of the filed <br />complaint. <br />o ASAP Towing & Recovery Services, Inc. reserves the right to act under City Municipal Code, Chapter 20, <br />Sec. 20-13 (C) and Sec. 20-15 (C) The City, its agents, servants or employees, shall not be responsible or <br />liable in any manner for the damage incurred in the towing, storage, possession or disposition of such <br />vehicle, <br />ASAP Towing & Recovery holds indemnity and liability insurance under the Korson, Inc,, the parent company, of ASAP <br />Towing & Recovery. Liability insurance covers up to 1,000,000,00 and is held by Arrowhead — certificate #1688980991, <br />policy #327799. <br />ASAP assumes all risk in the event of damage, theft, fire, or otherwise, of the vehicles or any other property towed, <br />impounded, or stored by the company, its employees, or agents, <br />The company shall look solely and exclusively to the owner of the vehicle towed, impounded, or stored for payment of <br />services rendered and will hold no claims against the City of South Bend for costs or nonpayment. <br />
