neglected, or delayed work by Contractor, (5) acceleration of the progress schedule involving <br />services beyond normal working hours, or (6) default by Contractor. <br />5. Services (other than Basic Services during the Post -Constriction Phase) in connection with <br />any partial utilization of any part of the Work by Owner prior to Substantial Completion. <br />6. Evaluating an unreasonable claim or an excessive number of claims submitted by Contractor <br />or others in connection with the Work. <br />7. Services during the Construction Phase rendered after the original date for completion of the <br />Work. <br />8. Reviewing a Shop Drawing more than three times, as a result of repeated inadequate <br />submissions by Contractor. <br />9. While at the Site, compliance by Engineer and its staff with those terms of Owner's or <br />Contractor's safety program provided to Engineer subsequent to the Effective Date that <br />exceed those normally required of engineering personnel by federal, state, or local safety <br />authorities for similar construction sites. <br />PART 3 — SCHEDULE <br />A3.01 Professional Design Services <br />A. No work shall begin on the project tinder this agreement until the Consultant receives a written <br />notice to proceed from the Owner. <br />B. All work by the Engineer under this Agreement shall be completed and delivered to the Owner for <br />review and approval within the following time periods measured in calendar days with the <br />anticipated delivery dates: <br />a. Site Assessment & Survey 30 days 01/25/18 <br />b. Prepare Construction Documents 60 days 02/24/18 <br />c. Prepare & Submit Final Quote Package 75 days 03/11/18 <br />d. Construction Administration 2 days following notice from Contractor <br />e. Structural Assessment 30 day 01/25/18 <br />C. All dates shown are based on a Notice to Proceed received not later than December 21, 2017, <br />A3.02 Construction <br />A. Questions, clarifications or corrections requested by the Owner's construction personnel regarding <br />the interpretation of the Engineer's plans shall be addressed within a reasonable period of time <br />from the Engineer's receipt of the Owner request. <br />B.
