REGULAR MEETING DECEMBER 12, 2017 396 <br />ADOPT RESOLUTION NO. 61-201.7;-.- A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS APPROVING THE EXCHANGE OF PERSONAL PROPERTY WITH THE BOARD <br />OF COMMISSIONERS OF ST. JOSEPH COUNTY, INDIANA <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 61-2017 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH <br />BEND, INDIANA APPROVING THE EXCHANGE OF PERSONAL PROPERTY WITH <br />THE BOARD OF COMMISSIONERS OF ST. JOSEPH COUNTY, INDIANA <br />WHEREAS, the City of South Bend Board of Public Works (the "BPW"), the contracting <br />body of the City of South Bend, Indiana (the "City"), which exists and operates under the <br />provisions of Ind. Code 36-9-6, holds certain personal property (the "City Property"); and <br />WHEREAS, the City, by and through the BPW, acting on behalf of the South Bend Fire <br />Department, desires to exchange the City Property with St. Joseph County (the "County"); and <br />WHEREAS, the County, acting by and through the Board of County Commissioners (the <br />"Commissioners"), holds certain personal property (the "County Property") and desires to <br />exchange the County Property with the City; and <br />WHEREAS, pursuant to Ind. Code § 36-1-11-8, the City and the County may transfer or <br />exchange property with one another upon terms and conditions agreed upon by the entities as <br />evidenced by the adoption of substantially identical resolutions of each entity; and <br />WHEREAS, the County and the City agree to exchange the County Property and City <br />Property described in the attached Exhibit A; and <br />WHEREAS, the Commissioners and the BPW must both adopt substantially identical <br />resolutions to perform the exchange of personal property under Indiana law. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND BOARD <br />OF PUBLIC WORKS AS FOLLOWS: <br />1. The City of South Bend's exchange with St. Joseph County of the personal property described in <br />Exhibit A is hereby authorized and approved. <br />2. This Resolution shall be in full force and effect upon its adoption <br />The performance of the exchange shall occur only upon adoption of a substantially identical <br />resolution by the St. Joseph County Board of County Commissioners. <br />ADOPTED at a meeting of the City of South Bend Board of Public Works held on <br />December 12, 2017, on the 13th Floor of 227 W.
