<br />In the above named assessment roll, the Board hereby orders
<br />that on the I2th., day of February 1929, this Board will meet in their office in
<br />the City Hall at IO:Off A. M , to hear and receive remonstrances .from all persons
<br />whose property has been assessed for said improvement and will decide whether .the
<br />several lots and parcels of Iand primarily assessed for said improvement have been
<br />benefited in the amounts named on said roll or in a greater or less sum than that
<br />named on said primary roll.

<br />Bids baying been received for the pavement of ;'fan Buren Street
<br />street to Lawndale Avenue under Improvement -Resolution No.2I68, the
<br />Board, -this 5th. day of February 1929, hereby, makes a preliminary order for sheet
<br />asphalt ravement heavy traffic as the 1pe of pavement with which said street shall
<br />b,e improved and sets the I9th., day of ebruary 1929, as the time when said Board
<br />shall either pass on petitions for a change -in the type of pavement ether 'than that
<br />specified in the preliminary order, award the contract or reject all bids.
<br />Upon the request of the Board, I.r. I. S. Romig, - City attorney,
<br />bmltted the following written recommendation with reference to the repairs on
<br />the grin Street Sewer:
<br />"Board of . Public `storks,
<br />South Bend, Indiana.
<br />Gentlemen:
<br />lir. Wray has asked me to give you a letter advising what to do
<br />in the case of the crumb Ting away of the Sorin Street Sewer at its .mouth. He states
<br />that it *J11 cost more than $5,000.00 to make the repairs and that each day's delay
<br />enlarges the defect and increases the cost of repair .and in the event of a thaw or e
<br />rain there might, besid-s a suddne great increase in expense of repair, be disastre
<br />gg
<br />results as the washing away of homes.
<br />It is understood, of course, that you do not have the money
<br />appropriated for that purpose and the expense exceeds that which you are authorized
<br />to contract under the law without furst having an appropriation therefor. It is also
<br />understood that you have no way of making assessments and placing the cost against
<br />properties. However, this is an emergency. You can get as low bids by direct
<br />submission to contractors as you can by going through the formal rountine of publica-
<br />tion amd advertising for bids. The only question then is, will the Council stay by
<br />you and apt opriate the money and are you taking any chances by entering into this
<br />contract without the us0al formalities?
<br />In addition to fir. adray's statement, he had Councilman Thornton
<br />of the fourth Ward. in which the improvement is situated, investigate and the CouncfZx
<br />man bears out Mr. *ray's statement that the matter is serious and needs immediate
<br />attention. He made this statement to the other members of the Council last night
<br />and all members were there excepting one and they unanimously stated that your Board
<br />should proceed forthwith and they would appropriate whatever sum was necessary to
<br />bear the expense. It is a time when you cannot delay in order to comply with
<br />formalities and with this s'^owing every Court will protect you.
<br />I would, therefore, advise that you proceed at once to remedy
<br />the defect and prevent further loss.
