<br />Bids having been received for the construction of pavement on 23rd.,
<br />Street from Mishawaka Avenue to a point 45 feet south of center line of Xerslake
<br />Court projected under Improvement Resolution No.I949, the Board this I4th., day
<br />of -lurch I928, hereby makes a preliminary order for sheet asphalt as the type of
<br />pavement with which said street shall be improved and sets the 27th. , day of March
<br />I926,as the time when said Boardshall either act on petitions for a change of the
<br />type of pavement other than that specified in the preliminary order, award the
<br />contr,..ct or reject all bids.

<br />Improvement Resolution No.I980 the Board this 14th., day of larch, 1928, hereby
<br />maItes a preliminary order for agp, con -or et - as the type of avement with which said
<br />street shall be improved and sets the 27th., day of Marchm 928, as the time when
<br />said Board shall. act on petition for a change of the tvpe of pavement other than
<br />that specified in the preliminary order, award the contract or reject all bids.

<br />Pavement Improvement Resolution No.20I2 for the pavement on Dorothy
<br />Street from south line of concrete pavement on Prairie Avenue to Eviing Avenue.
<br />Improvement Resolution No.20I3 for the pavement of 30th. , utreet From
<br />Mishawaka Avenue to North Side Boulevard. ( See files for copy of resolution.)
<br />.Improvement resolution No.2014 for the pavement of 36th., Street
<br />from Vishawaka Avenue to Northside Boulevard. (See files for copy of resolution.)
<br />In all of the above named improvement resolutions, the Board hereby
<br />orders that on the Ilth., day of April, 1928, this Board will meet in their office
<br />in the City Hall at 7-I5 P. 1.T., to -hear and receive remonstrances from all persons
<br />whose property is liable to .be assessed for said improvementsand will decide whether
<br />the benefits to the lots and parcels of land liable to be assessed for said improve
<br />menu will be equal to the estimated costs of same as reported by the City gineer.
<br />The Board further orders that notices of said hearings shall be published in the
<br />South Bend News Times and Tribune on the I?th., day of Karch and on the 24th., day
<br />of March 1928 and that notices be mailed to property owners according to law.
<br />This being the date set, hearing was had on the Assessment roll for
<br />the Condemnation (Easement) for the Northwest Trunk Sewer under Condemnation resolu-
<br />tion No.I769.
<br />In the above named assessment roll, Yr. Aaron Ii. Huguenard and J. W.
<br />Mclnerny, attorneys for the Chicago, South Shore and S6uth Bend Railroad Company,
<br />filed a written remonstrance against the award of damages for said raili-vay company.
<br />Mr. A. H. Huguenard read the remonstrance and expla nda same to the Board.
<br />Mr. E. F. Seibert, attorney filed a written remonstrance against the
<br />avra7d of damages for the Chicago, South Bend and orthern Indiana Railway Co.
<br />Yr. Samuel Pettingill, attorney for the J. ^J. Duxinegan Construction
<br />Company and John Gilmore superintendent of the Dunnegan Construction Co., together
<br />with City Attorney I. S. Romig were also present.
<br />In the above .named assessment roll, after h aring all persons interested
<br />in same, the motion was duly made and seconded and unamiously decided to modify.the
<br />assessment roll as the correction of names as follows:
<br />I. "Chicago, South Shore and South Bend Railway Co., ( Sometimes known as
<br />"hicago, South Shore and South Bend Railroad, a corporation) &.Joseph
<br />E. & 1"Lary E.-Kaley" changed to read "Chicago, South Shore and 6outh
<br />Bend Railway Co., ( Sometimes knovrn as Chicago, South Shore and South
<br />Bend Railroad, a Corporation, & Yotor Industries, Inc.,". Page I.
<br />2. "Bendix Brake Co," changed to read 9 otor Industries, Inc." Page 2.
<br />After modifying, the assessment roll as to the coreetness of names
<br />as shown above, the Board decides to continue hearing on sate. Assessment roll until
<br />Friday mo=±ng, A_arch I6th. , 1928, at I0:00 A. V.
