<br />The Contracts & Documents and Specifications for the Sewer Improvements for Duey Street and Oliver, Ar-
<br />nold, & Webster Streets is hereby approved and signed by the Board this 9th day of September, 1957.
<br />' This being the date set, hearing was held on the matter of the Petition of the Bowman Cemetery Associa-
<br />tion of St. Joseph County, State of Indiana, for the City of South Bend to Accept the transfer of said
<br />Cemetery. Appearing before the Board at this time are Jack Hildebrand, President of the Bowman Ceme-
<br />tery Association of St. Joseph County, South Bend, Indiana, and Cecil D. Walz, Secretary theregf, Mr.
<br />John Suasum, Sexton of said cemeter, Mrs. John Sausman, and a Mrs. Eva Suddarth. There are no remonstra-
<br />tors in regards to said petition. Submitted to the Board by Jack Hildebrand at this time are a Quit -
<br />Claim Deed, Affidavit, and an Assignment of all its right and interest. The Board will now hold these
<br />instruments and will make its decision by Monday, September 16, 1957 as to the acceptance or rejection
<br />of the Bowman Cemetery, to the City of South Bend.

<br />VACATION RESOLUTION NO. 2863 1957
<br />This being the date set, hearing was held on the Resoltuion heretofore adopted by the Board of Public Works'
<br />and Safety for the vacation of ARTHUR STREET from the North line of Chalfant Street to the South line of
<br />Campeau Street subject to the right and easement of Northern Indiana Public Service Company to operate
<br />maintain, repair and replace its pipe lines and mains now located under said Arthur Street and further
<br />subject to the easement and right of Indiana & Michigan Electric Company to maintain, repair, replace and
<br />use its poles and wires across Arthur Street and therefore these rights must be preserved, under Vacation
<br />Resolution No. 2863, 1957. The Clerk of the Board having shown sufficient proofs of publication and no
<br />remonstrators having appeared and no written remonstrances having been filed with the Clerk, it was moved,:;
<br />seconded and unanimously carried that the said Resolution be finally adopted and the said Street be va-
<br />cated. The Engineering Department is directed to prepare an assessment roll covering the assessment of
<br />benefits and the award of damages to the surrounding properties.
<br />R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards of damages and the assess
<br />ments of benefits in the matter of the vacation of ARTHUR STREET from the north line of Chalfant Street
<br />to the South line of Dampeau Street subject to the right and easement of Northern Indiana Public Service
<br />Company to operate, maintain, repair and replace its pipe lines and mains now located under said Arthur
<br />Street and further subject to the easement and right of Indiana & Michigan Electric Company to maintain
<br />repair, replace and use its poles and wires across Arthur Street and therefore these rights fppst be pre-
<br />served, under Vacation Resolution No. 2863, 1957.
<br />In the above named assessment roll, the Board hereby orders that it will meet in the City at 10:00 A.M.
<br />(DST) on the 7th day of October, 1957 for the purpose of hearing and receiving remonstrances from all
<br />persons interested in or affected by said vacation and the Board further orders that notice of said hear-
<br />ing toghether with the amount of damages awarded and benefits assessed be addressed to the property own-
<br />ers by publishing same on the 13th day of September, 20th day of September, and on the 27th day of Sep-
<br />tember, 1957 in the South Bend Tribune, and The Record.

<br />The bids for the improvement of Vassar Avenue from Brookfield Street to College Street by constructing
<br />a permanent type class "C" pavement received on September 3, 1957, in accordance with Improvement Reso-
<br />lution No. 2854, 1957 passed by this Board on July 15, 1957, and confirmed by this Board on August 19,
<br />1957, are hereby referred to you for examination and tabulation and to report to this Board with recommen-
<br />dations.

<br />In the matter of the bids for the improvement of Vassar Avenue from Brookfield Street to College Street
<br />by constructing a permanent type Class "C" pavement in accordance with Improvement Resolution No. 2854
<br />and confirmed by this Board on August 19, 1957 we hereby report that we have examined the several bids
<br />submitted to the Board on September 3, 1957 and find that the Reed Construction Company has the lowest
<br />and best bid for a Class "C" Type 1 Cement Concrete Pavement and that the Reed Construction Company has
<br />the lowest and best bid for a Class "C" Type 3 Bituminous Concrete Pavement.
