645' <br />• <br />• <br />0 <br />• <br />• <br />The Clerk of the Board having shown sufficient proofs of publication and no remonstrators having appeared <br />before the Board and no written remonstrances having been filed with the Clerk, it was moved, seconded <br />and unanimously carried that the said Resolution be finally adopted and the said alley be vacated. <br />i <br />The Engineering Department is directed to prepare an assessment roll showing the assessment of benefits <br />and the award of damages to the surrounding properties. <br />R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards of damages and the assess:= <br />ment of benefits in the matter of the vacation of: <br />1. Bryan Street from the East line of Cushing Street easterly a distance of 748 feet to <br />the easterly line of Lot 265 extended southerly across said Bryan Street. <br />2. An alley 14 feet in width running in a northerly and southerly direction from the north <br />line of Beale Street north to the South line of an alley running easterly and westerly between <br />the east line of Cushing Street and the St. Joseph River, which said alley is bounded on <br />the West by the easterly line of Lots numbered 252, 259, and 267 in Northwest Third Addition <br />and which said alley is bounded on the East by the westerly line of Lots 251, 260, and 266 <br />of part of Northwest Third Plat. <br />3.An alley, being 14 feet in width east and west, running north and south from the north line <br />of an alley running east and west between Beale Street and Bryan Street northerly to the <br />South line of an alley which runs in an easterly and westerly direction between the east <br />line of Cushing Street and the St. Joseph River, which said alley being vacated is bounded <br />on the west by the east line of Lots 261, and 266 in Northwest Third Addition and on the <br />east by the west line of Lots 261 and 265 of Northwest Third Plat. <br />4. An alley 14 feet in width east and west running in a northerly and southerly direction <br />from a point on the north line of Bryan Street north to the south line of an alley running <br />in an easterly and westerly direction between the east line of Cushing Street and the St. <br />Joseph River, which said alley is bounded on the west by the east line of Lot 265 and on the <br />the east by the west line of Lot 264 of Northwest Third Plat. <br />5. An alley 14 feet in width North and South running east and west between Bryan Street and <br />Beale Street and Beale Street from the east line of Cushing Street easterly a distance of <br />374.04 feet, all in Northwest Third Addition. <br />6. An alley 14 feet in width running an easterly and westerly direction from the east line of <br />Cushing Street easterly a distance of 1002 feet, which said alley is the first alley north <br />of Bryan Street and is bounded on the south by the north line of Lots 264, 2652 266, and <br />267 of Northwest Third Plat, <br />all under Vacation Resolutionr:No. 2864, 1957. <br />In the above named assessment roll, the Board hereby orders that it will meet in the City Hall at 10:00 <br />A.M. (DST) on the 7th day;,of-.October;:1957 for the purpose of hearing and receiving remonstrances from <br />all persons interested in or affected by said vacation and the Board further orders that notice of said <br />hearing, together with the amount of damages awarded and benefits assessed be addressed to the property <br />owners by publishing same on the 13 day of September, 20th day of Septermber, and on the 27th day of <br />September, 1957 in the South Bend Tribune and The Record. <br />The following property may be injuriously or beneficially affected by such vacation: <br />Lots numbered 264, 265, 266, 2672 2519 252, 2592 260, and 261 - NORTHWEST ADDITION THIRD PLAT <br />TOTAL NET BENEFITS------------00.00 <br />TOTAL NET DAMAGES-------------00.00 <br />Respectfully submitted this 3rd day of September, 1957. <br />Attest: Anthony J.
