580 <br />WHEREAS, this Board finds that the estimated cost of the construction, reconstruction and improvement of J <br />said streets and the incidental expenses in connection therewith will be in the amount of One Million Dollars <br />($1,000,000.00); now, therefore, <br />BE IT RESOLVED by the Board of Public Works and Safety of The City of South Bend, Indiana, that this Board <br />request the City Controller of said City and the Common Council of said Cityto take proper steps immediatell <br />to provide the necessary funds for said purpose, in the amount of One Million Dollars ($1,000,000.00)9 and <br />to that end that a dopy of this resolution be ;'f.iled with the City Controller and City Clerk,and presented <br />to the Common Council at the next meeting thereof. <br />Adopted this 22nd day of April, 1957. <br />Frank J. Smith <br />Board of Public Works and Safety <br />VACATION RESOLUTION NO. 2852. 1957 <br />This being the date, set, hearing was held on the assessment roll showing the award of damages and the assess- <br />ment of benefits in the matter of the vacation of the 10 FOOT PUBLIC WALK FROM; YORK ROAD TO THE EAST LINE 00 <br />BROADMOOR FOURTH SECTION,.under Resolution No. 2852, 1957. <br />a . <br />In the above named assessment roll, no remonstrators appeared and no written remonstrances were filed. The <br />Clerk of the Board submitted proofs of publication of notices and same were found sufficient, and the Board; <br />therefore finds that the walk has been benefited and damaged in the amounts shown on said roll, The Board <br />therefore decides to take final action on said assessment roll and declares same in all things ratified, <br />confirmed, and approved without modifications and the proceedings closed, and the alley vacated upon.re- <br />ceipt of the amount of benefit assessments from the various property owners so benefited and all proceedings' <br />had with reference to said vacation are hereby sustained. <br />VACATION RESOLUTION NO. 2853, 1957 <br />This being the date set, hearing was held on the Resolution heretofore adopted by the Board of Public Works' <br />and Safety for the vacation of LOCKE-STREET FROM THE WEST LINE OF IOWA STREET WEST 120 FEET; ALSO FROMTHE <br />EAST LINE OF A 19 FOOT PUBLIC ALLEY (OR RIGHT OF WAY) EAST 120 FEET, under Vacation Resolution No. 2853, 1957. <br />The Clerk of the Board having shown sufficient proofs of publication and no remonstrators having appeared be- <br />fore the Board and no written remonstrances having been filed with the Clerk, it was moved, seconded and u <br />namimously carried that the said Resolution be finally adopted and said street be vacated. <br />IThe Engineering Department is directed to prepare an assessment roll showing the assessment of benefits and`' <br />'the award of damages to the surrounding properties. <br />i <br />!R. Andrysiak, Citgr Engineer, filed primary assessment roll showing the awardsof damages and the assess- <br />ment of benefits inthe matter of the vacation of LOCKE STREET FROM THE WEST LINE OF IOWA STREET WEST 120 <br />,FEET ALSO FROM THE EAST LINE OF A 19 FOOT PUBLIC ALLEY (OR RIGHT OF WAY) EAST 120 FEET, under Vacation Reso- <br />lution No. 2853, 1957. <br />'In the abovenamed assessment roll, theBoard hereby orders that it will meet in the City Hall at 10:00 A.M. <br />!.(DST) on the 20th day of May, 1957 for the purpose of hearing and receiving remonstrances from all persons <br />interested in or affected by said vacation and the Board further orders that notice of said hearing toget- <br />iher with the amount of damages awarded and benefits assessed be addressed to the property owners by publish+ <br />ing same on the 26t1f day of April, 3rd day of May, and on the loth day of May, 1957 in the South Bend Tribune <br />and The Record. <br />The following property may be injuriously or beneficially affected by such vacation: <br />Lots numbered 12, 13, 36,and 37 - ALWARD'S ADDITION <br />Total net benefits <br />Total net damages <br />Respectfully submitted this 22nd dayof April, 1957. <br />00.00 <br />00.00 <br />R.
