H' iM <br />A letter was directed to Mr. George Swiatowy, 1701 Magnolia Street with reference to the in- <br />tolerable dust condition in connection with the property owned by said Swiatowy in the vicinity of 1500 <br />blbck W. Indiana Avenue which is rented to the Marion Trucking Company. Mr. Swiatowy is hereby requested <br />to .appear at the next regular Board meeting on Monday, June 18, 1956. <br />a <br />1 <br />A letter was received from Danny Richardson; Street Commissioner, in compliance with the request <br />of the estimated oiling cost of West Washington Street and from Kaley St. to Sheridan Street. <br />A petition was received from Armour and Company for the vacation of;,alley between Armour and <br />Company Brance House and Lots 20 and 21 in Perkins' 2nd Sub -division of Bank Out Lot 76 and was referred tp • <br />the City Planning Commission for further investigation and report. <br />i <br />A petition was received for the improvement of Huron Street from Arnold Street west to Webster <br />Street by the construction of a sanitary Sewer by the Barrett Law Plan. Petition referred to the City <br />Engineering Department. <br />Contract Supplement No. 30, under Contract No. 11 of the Sollitt Construction Company, Inc. <br />dated June 11, 1956 was received and placed on file. <br />This being the date set, the hearing on the matter in: connection with the demolition order to <br />a building on the property at 677 LaPorte Avenue which is owned by Mr. & Mrs. David Scruggs, 677 LaPorte <br />Avenue was heEd. Matter referred to Mr. Smith, City Attorney. • <br />Verner L. Lane, Building Commissioner, requests that a hearing be held on Monday, June 18, 1956 <br />with reference to a demolition order in connection with a building on 668 LaPorte Avenue which is owned by <br />Max and Sara Jacobs, 753 Cottage Grove. Request granted. <br />This being the date set, the hearing with reference to the remonstrance submitted to the Board <br />by Frank & Mary Eazsol, 2502 Roger Street against the moving of a building in onto -.Lot 230 in Kaley's Third <br />Addition was held. Attorney Helling representing Mr. Link, the applicant for the moving permit, appeared' <br />before the Board and reports as follows: Section 454 of the Building Code of the City of South Bend state <br />that it shall be unlawful to move any building to any lot fronting on any street in any location of the 1 <br />City in which more than z of the buildings on both sides of the street for a distance of 300 feet in each <br />direction along such street are occupied exclusively for residence purposes without a frontage consent for • <br />150 feet in each direction along such street from the proposed site. Therefore, Attorney Helling having <br />investigated the conditions reports that there are no residents situated within 150 feet of the proposed <br />site that the building is to be moved; there are no building residences on the opposite side of the streq� <br />in either direction; and that the only building within 300 feet of the proposed site is one residence <br />175 feet from proposed site. The Board now sustains the report of Attorney Helling and the decision of <br />the Building Commissioner and hereby orders that -the said moving permit is to be issued. <br />Mr. Thomas Bright of Brinks Armoured Truck Service, 105 West Wayne Street appeared before the <br />Board with reference to request permission to place a meter bank at the plant building on Saturdays only <br />from 9 A.M. to 3 P.M. for the purpose of check cashing. Matter taken under advisement. <br />i <br />Mr. and Mrs. Frank Brodie, 114 South Lake Street appeared before the Board with reference to !� • <br />the dust condition in a vicinity between Washington and Jefferson Streets. Ray Andrysiak directs that <br />the Brodie's collect 2 of the total amount for an oil treatment of said vicinity and deposit with the <br />City Controller. <br />II <br />The publication for the pick-up trucks for the Street Department will be re -advertised on the { ' <br />15th day of June and on the 22nd day of June and bids will be teceived on the 25th day of June. i <br />The plans for the street improvement of Churchill Drive from Campeau Street to Corby Street <br />and the plans for Cavanaugh Drive and Gartner Avenue from Chruchill Street to Corby Street were approved <br />and accepted by the Board. <br />VACATION RESOLUTION N0: 2833 • <br />This being the date set, hearing was held on the assessment roll showing the award :of damages <br />and the assessment of benefits in the matter of vacation of the ALLEY RUNNING PARALLEL WITH LINCOLNWAY <br />EAST FROM THE SOUTH LINE OF THE ALLEY SOUTH OF SAMPLE STREET, THENCE SOUTHEASTERLY TO THE SOUTH LINE OF <br />LOT H OF WENGER AND KREIGHBAUM'S VISTULA AVENUE ADDITION WHERE SAID ALLEY ABUTS THE GRAND TRUNK WESTERN <br />RIGHT OF WAY, under Resolution No. 2833. <br />In the above named assessment roll, no remonstrators appeared and no written remonstrances were <br />filed. The Clerk of the Board submitted proofs of publication of notices and same were found sufficient,! <br />and the Board therefore finds that the alley has been benefited and damaged in the amounts shown on said • <br />roll. The Board, therefore decides to take final action on said assessment roll and declares same in all, <br />things ratified, confirmed, and approved without modification and the proceedings closed, and the alley jl <br />vacated upon receipt of the amount of benefit assessments from the various property owners so benefited ! <br />and all proceedings had with reference to said vacation are hereby sustained. j <br />VACATION RESOLUTION NO. 2832 <br />This being the date set, hearing was held on the assessment roll showing the award of damages <br />and the assessment of benefits in the matter of the vacation of THE ALLEY WEST OF OLIVE STREET FROM LIN- <br />COLNWAY WEST, SOUTH TO THE NORTH LINE OF THE ALLEY SOUTH OF LINCOLNWAY WEST, under Vacation Resolution <br />No. 2832. <br />In the above named assessment roll, no remonstrators appeared and no, written remonstrances, wens <br />
