Miller, complaint ('concerning the use of Lombardy Drive by an excessive amount of heavy truck traffic, in - !,eluding -semi -trailers. I STREET DEPARTMENT: Street Commissioner, H. M. Tomlinson, being present, reported to the Board the stopping of Street Department trucks, by a citizens barricade of two or more persons on Corby Boulevard, while engaged in special work in connection with the park -playground construction activities at the new Edison Bchool site. The Board took the matter under advisement, and instructed the 'Street Commissioner to avoid the use of this street by ;Street Department trucks until further advised by the Board. The Board next considered complaint concerning property of Vernon C. Hastings, located at.114 E. Keasy Street, and the Clerk was directed to notify Mr. Hastings a period of ten days will be permitted him in which to "clean up" these premises. VACATION RESOLUTION NO. 2817 This being the date set, hearing was had on the resolution here'tof ore adopted by the Board of Public Works and Safety, for the vacation of the ALLEY BETWEEN MICHIGAN AND MAIN STREETS from the south line of Dean Street to the north line of Sherwood Street,i. under'Vacation Resolution No. 2817. The Clerk of the Board having shown sufficient proofs of publication and no remonstrators having appeared and no written remonstrances having been filed with the Clerk, it was moved, seconded and unanimously carried that the said resolution be finally adopted and the said alley be vacated. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits -and the award of damages to the surrounding properties. R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards 1 of damages and the assessments of benefits in the matter of the vacation of ALLEY BETWEEN MICHIGAN AND MAIN STREETS from the south line of Dean Street to the north line ?of Sherwood Street, under Vacation Resolution No, 2817- In the above named assessment roll, the Board hereby orders that it will meet in. the City Hall at 10:00 A. M. C.S.T. on 7th day of November, 1955, for the purpose of hearing and receiving remonstrances from all persons interested in or affected by said (vacation, and the Board further orders that notice of said hearing, together with the [publishing amount of damages awarded and benefits assessed be addressed to the property owners by same on the 14th day of October, on the 21st day of October, and on the 28th jday of October, 1955, in the South Bend Tribune and Tri-County News. Mr. Victor Terhune representing Rieth-Riley Construction Company, together with Mr. E. A. Smith of the engineering firm of Chas. W. Cole & Son, being present, the Board thru Chairman, R. S. Andrysiak, directed the Rieth-Riley Construction Company proceed with the resurfacing of Kemble Avenue, from Prairie Avenue to Ewing Avenue, and South Street, from Lafayette Boulevard to Taylor Street; the latter.to include the widening of the street to the,existing new.curbing installed by the Department of Public Parks along The Plaza. Discussion was next given the low bid, submitted by Rieth-Riley Construction Co., for the paving of Sample Street, from Kentucky Street to Falcon Street. Due to un- certainties prevailing, it was deemed advisable to defer this work to next spring. IMPROVEMENT RESOLUTION NO. 2816 CONFIRMED For the improvement of FREMONT STREET from the north line of Elwood Avenue to the south line of Keller Street, under Improvement Resolution No. 2816, 1955, adopted September 6, 1955, by constructing a Class "C" pavement. After hearing all persons interested who appeared and being fully advised on the premises and the Clerk of the Board i having Shown proofs of publication of the notices t6 property owners and the same having been found sufficient, the Board decides that the benefits to the property liable to be assessed for said improvement are equal to the estimated cost of the same as reported by the City Civil Engineer, therefore BE IT RESOLVED by the Board of Public Works and Safety of the City of South Bend, Indiana, that Improvement Resolution No. 2816, 1955, duly passed by this Board on -- September 6, 1955, for the above improvement, be and the same is hereby in all things confirmed and the improvement is hereby ordered -to be made.
