<br />Then appeared before the Board, H. D. Hallberg, Plant Manager., U. S. Gypsum Co.
<br />1702 Franklin Street, in response to the Board's request. Mr. Hallberg explained that
<br />the use of motor operated fans is an absolute -necessity because of the use of asphalt
<br />in their production activities, and an accumulation of asphalt fumes would produce an
<br />explosion. Mr. Hallberg further stated., the U. S. Gypsum Company has been in operation
<br />at this -site for twenty-two years and the McHenry Millhouse Corporation conducted similar:
<br />production in this plant for many years previous. Mr. Hallberg agreed to contact a
<br />Mr. James Falvey, one of the petitioners, with a view to discovering their principal
<br />source of complaint, and advise the Board of whatever steps U. S. Gypsum Company may
<br />propose to take toward the reduction of the objectionable noise.
<br />The Board next examined Supplemental Agreement No. 1 In connection with the
<br />ami-St eet Pavement Improvement, and finding the additional work indicated to be
<br />necessary and in order, proceeded with the signing of the agreement.
<br />!STREET DEPARTMENT.
<br />• H* M. Tomlinson., Street Commissioner, being present, discussed with the Board
<br />matters pertaining to his department. Mr. Tomlinson urged the Board to give Bartlett
<br />,ptreet preferred attentinn and expedite the. resurfacing of this_ street, from Michigan
<br />iptreet to Riverside Drive, in every way possible. The Board agreed to advise the con -
<br />'tractor accordingly.
<br />A letter of remonstrance against the proposed paving of Fremont Strebt, dated
<br />September 30, 1955, was read and ordered placed on file.
<br />A letter from Chas. W. Cole & Son, consulting engineers, dated September 29, 1955,
<br />;over the signature of E. A. Smith, recommending the awarding of Eddy Street Contract
<br />No. 3, from Madison to Sorin Street, to Reed Construction Company, in accord with their
<br />' low bid of VA,970-00, was next read by the Board. The Board then proceeded with the
<br />:'approving of Performance and Maintenance Bonds, and the signing of contract.
<br />The Board approved Plans and Specification for improvement on Eisenhower Avenue
<br />,trom. Crosby Avenue to Delano Avenue and Crosby Avenue from Benedict Avenue to Eisenhower
<br />Avenue, submitted by Clyde E. Williams & Associates.
<br />The request of River Park Methodist Church for the roping -off of that portion of
<br />:23rd Street immediately in front of the church, from two o'clock to five o'clock, Sunday
<br />Afternoon, October 23rd, for the cornerstone laying program, was next considered and
<br />:approved by the Board. The Street Commissioner., being present, was informed accordingly.
<br />• A request from Mr. Mort Linder for permission to use the downtown ornamental
<br />,light posts for the postihg of signs for the United Fund Drive, was next considered and
<br />Approved.

<br />KNOW ALL MEN BY THESE PRESENTS, That Frank A. Slaby and Alice E. Slaby, husband
<br />'and wide, for and in consideration of one Dollar ($1,00) and other valuable consideration,',
<br />receipt of which is hereby acknowledged, do hereby convey, transfer and dedicate to the
<br />;City of South Bend, Indiana, an easement and right of way for street purposes over the
<br />Following described real estate in St. Joseph County, State of Indiana, to -wit:
<br />A lot or parcel of land in the East one-half of the North
<br />East quarter of Section No. 34, Township No. 38 North, Range No.
<br />2 East, bounded by a line running as follows: viz. -
<br />Beginning 'at a point 206-7 feet South of the Northeast
<br />corner of said Section No. 34; thence running West a
<br />distance of 30 feet; thence North 178-5 feet to the place
<br />of beginning, being the East 30 feet of Lots Numbered
<br />30., 31 and 32 in an unrecorded Plat of Jackson's Sub-
<br />division in the City of South Bend.
<br />The aforementioned realty is hereby dedicated for a public street, and a permanent
<br />easement is hereby granted therefor as well as for the installation of sewers and other
<br />• public utilities in and on the realty specifically described herein.
<br />IN WITNESS WHEREOF, said Frank A. Slaby and Alice E. Slaby, husband and wife, have
<br />executed this conveyance as of the 16th day of September, 1955-
