317 <br />O <br />A petition, filed with the Board by six down -town merchandisers, complaining of <br />unsightly appearance and certain hazards created by the news-stand on the southwest <br />corner of Michigan and Washington Streets, was next read and considered by the Board. <br />In view of the definite loss -sustained by these merchants, as pointed out in their <br />petition, together with its conceded unsightliness and the excess of siedwalk area <br />,occupied by this stand, the Board orders its removal on or before June 1, 1955, and <br />directs the Clerk to have such notice served upon the operators, Mr. and Mrs. Robert <br />i <br />A. Brooks. <br />• The Board next considered the matter of a type of window display contemplated by <br />Franckowiakts, Inc., and were advised by the City Attorney, under Section 13, Chapter8`' <br />iiof the Municipal Code, this particular type of display is forbidden. The Board directed <br />the Clerk to so notify Frankowiakts, Inc. <br />1i <br />• <br />The Board next gave consideration to the appointment of Ray Riffell, Inc., as <br />plastering sub -contractor under Contract No. ll,'Sewage Treatment Plant. This appoint - <br />menu, being recommended by Consoer, Townsend & Associates was approved accordingly, and <br />the Clerk was directed to give Ray Riffel., Inc., written notification in accord with <br />Page E-7 of the Contract Documents. <br />j Supplement to Contract Supplement No. 1, Contract 5-A, Paschen Contractors, Inc., <br />licontractor, was then examined and having been recommended for acceptance by the con- <br />11sulting engineers, Consoer, Townsend and Associates, the Board granted their approval. <br />A letter from Chas. W. Cole & Son, dated March 31, 1955, addressed to the City <br />Engineer, pertaining to the General Street Improvement Program, was read and ordered <br />placed on file. <br />Councilman W. A. Hahn then appeared before the Board calling attention to the fact <br />that property titles to lots on North Shore Drive extend to the edge of the St. Joseph <br />River, thereby giving the residents of such property full rights and authority over <br />river banks in that area from Michigan Street to Angella Boulevard. The Board agreed <br />that such was the legal status and that such residents were within their rights in <br />('posting "No Trespassing" signs on this shore area, which the Councilman stated is being <br />{used as picnic grounds and littered with picnic refuse. The Councilman was advised <br />that violation of such posted notice would subject trespassers to arrest. <br />The Board approved the installation of YIELD RIGHT OF WAY sign on southeast corner <br />of Pyle Avenue at Edison Road. <br />Contractorts Bond, in the sum of $1,000.00, for Interstate Maintenance and Engineering <br />Company, was examined and approved. <br />There being no further business to come before the Board, the meeting was adjourned <br />at <br />11:30 A.
