253 <br />ii <br />i� <br />VACATION RESOLUTION NO. 2800 - 1954 <br />This being the date set, hearing was held..on the assessment roll showing the <br />award of damages and the assessment of benefits `yin the matter of vacation of TEN FOOT <br />PUBLIC WALKWAY BETWEEN LOTS 314 and 315 IN EDISON PARK ADDITION AND TEN FOOT PUBLIC <br />WALKWAY BETWEEN LOTS 333;af,id 334Y xxt 3-3.1 IN.EDISON PARK ADDITION, under Vacation <br />Resolution No. 2800, and 1i}:foot public alley between lots 328, 329, 330 and 331. <br />• In the above named assessment roll, no remonstrators appeared and no written <br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of <br />notices and same were found sufficient, and the. Board., therefore, finds that the several <br />lots and parcels of land have been benefited and damaged in the amounts shown on said <br />roll. The Board, therefore, decided to take final action on said assessment roll and <br />declares same in all things ratified, confirmed and approved without modification, and <br />the proceedings closed, and the walkways and alley vacated upon receipt of the amount <br />1_of benefit assessments from the various property owners so benefited and all proceedings <br />l had with reference to said vacation are hereby sustained. <br />The Board next examined the report of Traffic Engineer, E. H. Miller, dated <br />jOctober 27, 1954, relative to the blocking of the Sunnyside Avenue railroad crossing <br />l�by the Grand Trunk Western R. R. Companyts special football train, in line with the <br />(railroad companyts request. The Board then directed the Clerk to inform the Grand <br />Trunk Western Railroad Company that their request must be denied, and to furnish copy <br />�lof the Traffic Engineerts report for the railroad companyts information and guidance. <br />The Board next considered and passed the following resolution: <br />BE IT RESOLVED: that additional right of way be granted to the west side <br />hof Bendix Drive, from Lincolnway West north to Elwood Avenue, to conform with the <br />114existing right of way on Bendix Drive south of Lincolnway West, AND <br />FURTHER BE IT RESOLVED, that a set -back building line be established to provide <br />'for the anticipated widening of Bendix Drive north of Lincolnway West. <br />it <br />Next appeared before the Board, Mr. R. W. Goheen, representing the National <br />Bank and Trust Company, together with another official of this bank and the architect, <br />presenting plans for the proposed drive-in branch bank on the west side of South <br />Michigan Street, between Indiana Avenue and Dubail Avenue. The architeetts drawing <br />was carefully studied and after considerable discussion, in which the Traffic Engineer <br />and the City Civil Engineer took active part, the Board approved the proposed con- <br />struction under the condition that the tellerts window be located at a point sufficiently <br />distant to the west to permit a second car on -the drive without encroaching upon the <br />sidewalk and:that a.suitable sign shall be placed on the building warning patrons, to <br />avoid blocking public walk, and a further condition being the construction ofa con- <br />crete bumper strip along the building. <br />Mr. Goheents attention was called to the necessity of securing a permit from <br />the State Highway_Commission, and the Board informed -Mr. Goheen the City Permit would <br />be forthcoming promptly thereafter. <br />i <br />The Board next examined -and approved Contract Supplement No. 1, pertaining to <br />Contract No. P-5; Independent Concrete Pipe Company, Contractor, upon the recommendation <br />of the consulting engineers, Consoer, Townsend and Associates. <br />RESOLUTION ADOPTING FINAL ASSESSMENT;ROLL <br />RESOLUTION NO. 2794 - GRANT STREET LOCAL SEWER <br />After hearing all persons interested who appeared and the Clerk of the Board of <br />iiPublic Works and Safety having proofs of publication of the notices to property owners <br />land the same having been found sufficient, therefore, <br />jl BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend, <br />;;Indiana, that the Primary or preliminary Assessment Roll adopted by the Board on the 18th', <br />T4day of October, 1954, for the improvement of GRANT STREET by constructing a local sewer <br />he and the same is in all things confirmed. <br />R.S.Andrysiak <br />J.A.
