<br />Next appeared two gentlemen, representing the Ambassador Club of Bethel College,
<br />requesting permission to conduct religious services Friday evenings on the sidewalk of
<br />Chapin Street at a point of their choosing, at or south of the intersection of Chapin
<br />and Monroe Streets. The Board granted the request with the stipulation that "a fairly
<br />good lane be maintained for pedestrian traffic", and that no tracts or pamphlets be
<br />distributed in violation of the City .ordinance.
<br />Next appeared Wm. S. Nickell of Michigan City, Indiana, with a view to installing
<br />benches at bus stops in certain locations. Inasmuch as this type of advertising was
<br />recently given thorough investigation and condemned by the Board, Mr. Nickell was so
<br />advised and dismissed.
<br />A petition, dated September 21, 1954, for the vacation of alley between West
<br />Donald Street and West Ewing Avenue in Swygart+s 5th Addition, was examined and referred.
<br />to the City Plan Commission for investigation and report.
<br />Cab -owner Ernest Zick then appeared before the Board, in protest to the Boardts
<br />failure to provide him a cabstand and outlined to the Board his safety record and
<br />experience over a period of years as a taxicab driver in South Bend. The Board set the
<br />next regular meeting at 10:00 A. MI. CST, as a date for a hearing in the matter, and
<br />the Clerk was directed to notify the cab owners and operators, together with Otto More-
<br />house, president of the Cab Driversi Union, accordingly.
<br />:?STREET DEPARMi NT:
<br />H. M. Tomlinson, Street Commissioner, being present, brought to the attention of
<br />Lithe Board, dust complaints and reports of damage to oiled streets, caused by excessive
<br />Muse by the activities of contractors in connection with work involved with the Cityts
<br />;;interceptor sewer system. The Board authorized Commissioner Tomlinson to proceed with
<br />certain grading and cleaning work on public property on Bartlett Street, Riverside Drive,;'!
<br />jand Gertrude Street. The Board directed that upon completion of this cleaning and
<br />,;grading, the contracting firm of Niles Excavating Company is to be billed in the amount
<br />!of $20.00 as their fair share of the cost.
<br />VACATION RESOLUTION NO. 2800 - 1954
<br />This being the date set, hearing was had on the resolution heretofore adopted
<br />by the Board of Public Works for the vacation of the TEN FOOT PUBLIC WALKWAY between
<br />;'Lots 314 and 315 in EDISON PARK ADDITION and TEN FOOT PUBLIC WALKWAY between lots 333 and;;
<br />{334 in EDISON PARK ADDITION and FOURTEEN FOOT PUBLIC ALLEY between Lots 328,329, 330 and
<br />331 in EDISON PARK ADDITION, under Vacation Resolution No. 2800.
<br />Attorney Warren Diehl and Leo Witucki, Division Supervisor of the Indiana & Mlichigar
<br />.,Electric Company appeared before the Board, representing the Indiana & Michigan Electric
<br />(Company regarding existing easements and rights of the Indiana & Michigan Electric Company.
<br />The Clerk of the Board having shown, sufficient proofs of publication and no remon-
<br />strators having appeared and no written remonstrances having been filed with the Clerk,
<br />,:it was moved, seconded and unanimously carried that the said resolution be finally
<br />'adopted and said walkways and alley be vacated, contingent upon public utility easements
<br />and rights being preserved to the -satisfaction of the Indiana & Michigan Electric Company.'
<br />The Engineering Department is directed to prepare an assessment roll covering the 11
<br />• assessment of benefits and the award of damages to the surrounding properties. j
