Parker was present and submitted drawing for replat of Lots Numbered 14 <br />through 37, and vacated alleys in Parker & Allen1s Addition to the City of South Bend, <br />Indiana. Mr. Parker also filed with the Board Cause No.95120 in the St. Joseph Circuit <br />Court, which decree covers vacation proceedings of the original plat which reads as <br />follows: <br />STATE OF INDIANA ) SS: <br />S T. JO SE P H C OUN TY <br />COLPAERT REALTY CORPORATION ) <br />VS DECREE <br />THE CITY OF SOUTH BEND, INDIANA ) <br />AND CITIZENS THEREOF <br />Comes now the plaintiff, Colpaert Realty Corporation, by its attorneys, Parker <br />& Parker; and comes also the City of South Bend, Indiana by its attorney, Irving <br />Hurwich; and come also Blanche 1.1. Dice and Helen Culver.by their attorney, George <br />Rulison, and Louise Cannady, Herschell Hartzell and wife, and Dren_man G. Tatman and <br />Hilda A. Tatman by their attorneys, Anderson &.7attles; and this cause, being at <br />issue upon plaintiff's petition and the answers of The City of South Bend, Indiana <br />and other interested persons who have appeared and represented by their said counsel, <br />is now submitted to the court without the intervention of a jury. <br />And the Court, having heard said petition, together with argument of counsel and <br />the evidence thereon, and being duly advised in the premises, finds: <br />1. That the allegations of plaintiff's petition are true with the exception that <br />the Lot Numbered Thirty-two (32) in said Parker & Allen Addition as originally pla.tte <br />is owned by Blanche 14. Dice and Helen Culver, and that plaintiff has no interest in <br />ten (10) feet off the North side of said Lot Numbered Thirty-two (32) as alleged in <br />its petition. <br />2. That plaintiff's purpose of increasing the size of the lots in said Parker <br />& Allen Addition so that all lots are accessible from the street line is consistent w th <br />the purposes of good planning in said City and is to the best interests of the <br />community.
