<br />A regular meeting of the Board of Public Works was held Monday, June 8, 1953,
<br />at 10:00 A. M. Mr. Ziegler was absent. Minutes of the previous meeting were read and
<br />approved. Salary claims in the amount of $25,628.89 were approved. Claims of the
<br />following suppliers, in the amount of ��21,328.07, were approved and ordered paid:

<br />First appeared before the Board Attorney Samuel Feiwell and his client, 1,1r. Stein
<br />in regard to proposed improvements on the property at 502-504 Chapin Street, presently
<br />under condemnation proceedings. A letter from Asstt. City Attorney, Arthur A. May, who
<br />was also present, directing the property owner to make certain specific improvements in
<br />compliance with fire, plumbing and health codes, and changes necessary to meet with
<br />the requirements of the City Electrical Inspector, was examined by the Board and the
<br />question put to Mr. Stein as to his intention of compliance. Mr. Stein stated that it
<br />was his intention to comply fully with all codes and conditions involved, exactly as
<br />set forth in Attorney Mayt s letter.
<br />There being no structural changes involved, and no�-bjection offered by Sergeant
<br />Coil, also present as a representative of the Department of Health, o pointed out
<br />that, inasmuch as the property, operating as.a hotel or rooming house,ill continue
<br />subject to his departmentts inspection and surveillance; the Board directed Mr. Stein
<br />to proceed without longer delay to make the specified improvements to place this
<br />I property in satisfactory and approved condition of housing usefulness.
<br />Sergeant Elmer Coil of the Department of Health, being present, next brought
<br />to the attention of the Board, a serious and urgent sewer condition involving the
<br />premises at 206, 210 and 214 South Kenmore Street. Sergeant Coil stated that the
<br />residents have exhausted every resource to correct the stoppage and backing up of
<br />sewage, which now presents a definite health hazard and that it is now certain that
<br />the failure is at a point beneath the pavement.
<br />Street Commissioner, Harry M. Tomlinson, being present, and having jurisdiction
<br />over the Sewer Department, was directed by the Board to make an immediate investigation
<br />and to proceed with excavation required to determine the cause, and if found not to be
<br />too extensive an operation for the Sewer Department to handle, to proceed at once with
<br />the repair.
<br />Plans for pavement improvement on Rockne Drive,from the east line of Ironwood
<br />Drive to the west line of Flag Avenue, submitted by Wilbur H. Gartner & Associates,
<br />was next examined and approved.
<br />IMPROVEMENT RESOLUTION NO. 2?57 - 1953
<br />BE IT RESOLVED, by the Board of Public Works and Safety of the City of South
<br />Bend, Indiana, that it is deemed necessary to improve FORD STREET- SCENIC DRIVE -
<br />LOMBARDY DRIVE by constructing a Class B. Type 1 - Cement Concrete Pavement.
<br />The same to be done in accordance with the profiles, drawings, plans, general
<br />details and specifications for such improvement approved June 8, 1953, and to be
<br />adopted by the Board of Public Works and Safety of the City of South Bend, Indiana,
<br />immediately upon the final adoption and confirmation of this resolution, and placed
<br />on file in the office of the Board of Public Works and Safety of said City, and such
<br />improvement is now ordered.
<br />The total cost of said improvement, including all incidental costs such as
<br />advertising, abstracting, printing and issuance of bonds, inspection and engineering,
<br />shall be assessed upon the real estate abutting on said STREETS to be improved, all
<br />according to the method and manner provided for in an Act of the General Assembly of
<br />the State of Indiana, entitled, "An Act Concerning Municipal Corporations" approved
<br />March 6, 1905, and .in accordance with and pursuant to the provisions of all amendatory
<br />and supplemental acts thereto, passed by the General Assembly of the State of Indiana.
<br />Assessments, if deferred, are to be paid in ten (10) equal installments, with interest
<br />at the rate of six (6) per cent per annum. (A bond or bonds shall be issued to the
<br />contractor in payment oassessments, as the several owners of real estate upon which
