• <br />n <br />• <br />The Board then took up the matter of the acquisition of land and equipment to <br />''handle the collection and disposal of tarbage and adopted the following resolution: <br />WHEREAS, the Board of Public Works and Safety of the City <br />of South Bend, Indiana, has determined that it would be <br />for the best interests of said City and its citizens to <br />provide for.the acquisition of the necessary land and <br />equipment for the collection and disposal by said City <br />of garbage by said City is necessary in order to protect <br />the health and well-being of the citizens and will be 6f <br />general benefit to the entire City: and <br />WHEREAS, the Board of Public Works and Safety finds that <br />the estimated cost of acquisition of the necessary land <br />and equipment and the incidental expenses in connection <br />therewith will be in the amount of One Hundred Fifty <br />Thousand Dollars (150,000.00); now therefore <br />BE IT RESOLVED by the Board of Public Works and Safety of <br />the City of South Bend, Indiana, that this Board requests <br />the City Controller and Common Council to take proper <br />steps immediately to provide the necessary funds for said <br />purpose, in the amount of One Hundred Fifty Thousand Dollars <br />(150,000.00) and to that end that a copy of this resolution <br />be filed with the City Controller and the City Clerk, and <br />presented to the Common Council at the next meeting thereof. <br />Adopted this llth day of I,'iay, 1953• <br />G. Hurwich <br />Board of Public Works & Safety <br />The Board next read the proposal for the Cityts use of some twenty-seven acres of <br />land'for sanitary fill purposes, submitted by the Tri-Valley Council, Boy Scouts of <br />America, and accepted their proposal, the agreement and conditions of which are set <br />forth under ten numbered paragraphs, as follows: <br />• 1. The holes located in these twenty-seven acres, in the area <br />otherwise known as Welber Woods, will be used by the City <br />of South Bend, Indiana, for the disposal of rubbish and <br />garbage by the sanitary land fill method. <br />2. The City of South Bend agrees to keep the location in a <br />neat condition. We will allow absolutely no.fires. <br />3. All scavengers must keep out of the way of operation. <br />4. No minors will be allowed in the immediate area. <br />5. Rubbish and garbage will be deposited in compacted <br />layers from four to six feet deep, and each layer <br />will be covered with fill dirt. <br />b. It is understood that fill dirt will be obtained <br />from the mounds of dirt now deposited around the <br />perimeter of the hole. <br />7. The Cite agrees to obtain all fill dirt from areas <br />set out or designated by the Scout Executive. <br />8. The City will be allowed to park some pieces of <br />• equipment at the sanitary land fill site during <br />the night hours. <br />9. At the end of the operation, when the hole has <br />been filled to within two feet of the normal <br />grade, we will cover the entire disposal area <br />with two feet of compacted dirt obtained from <br />the mounds as designated by the Scout Executive. <br />10. General: The Tri-Valley Council Boy Scouts of America - <br />through their executive, reserve the right to terminate <br />the entire agreement, if at any time the several con- <br />ditions as set out heretofore are not complied with. <br />A further resolution was then adopted, governing fees to be charged at the new <br />
