<br />Council Meeting and to present the costs and estimates stipulated.
<br />Next appeared before the Board, Nlr, Eugene Hauck with the complaint that he has
<br />for some years been compelled to pay taxes on property over which he exercises no
<br />control, with reference to the twenty -foot setback strip for the eventual widening
<br />of Eddy Street. Considerable discussion was given the matter, and the only immediate
<br />solution appeared to be outright, purchase of the area in question by the City. No
<br />steps were taken, howaver, in this direction by, the Board. Mr. Hauck stated that an
<br />offer of $1,000.00 for the 45 foot lot actually involved would be the lowest price
<br />acceptable.
<br />VACATION RESOLUTION NO.2744 - 1952
<br />This being the date sbt, hearing was held on the assessment roll showing the award
<br />of damages and the assessment of benefits in the matter of vacation of
<br />West Garst Street between Franklin Street and Plant No. 1 of
<br />the Studebaker Corporation, and the alley adjoining the west
<br />side of Lots 87, 88, 89, 90 and the north one-third(1/3) of
<br />• Lot No. 91, less 14 feet on the south side of the North one-
<br />third (1/3) of said Lot No. 91 and the alley 14 feet in width
<br />on the south side of Lot No. 90 extending west from Franklin
<br />Street to the property line of the Studebaker Corporation, as
<br />shown on the recorded Plant of South Bend City as platted by
<br />Samuel Morrison, now a part of the City of South Bend and more
<br />particularly described as follows:
<br />Beginning at a point which is the northeast corner of Lot 87
<br />as shown on the recorded Plat of South Bend City as platted
<br />by Samuel Morrison, now a part of the City of South Bend, located
<br />in the northeast quarter (1/4) of the northeast quarter (1/4) of
<br />• Section 14, Township 37 north, Range 2 east; thence due west
<br />a distance of 107.50 ft; thence due south a distance of 264.00 ft.;
<br />thence due east a distance of 107.50 ft.; thence due south a
<br />distance of 14.00 ft-; thence due west a distance of 107.50 ft.;
<br />thence due south a distance of 17.67.; thence due west a distance
<br />of 14 ft.; thence due north a distance of 348.37 ft.; thence due
<br />east a distance of 20.00 ft.; thence due north a distance of 10.10
<br />ft.; thence due east a distance of 101.50 ft.; and, thence due
<br />south a distance of 62.80 ft. to the point of beginning, under
<br />�I Vacation Resolution No. 2744.
<br />• In the above named assessment roll, no remonstrators appeared and no written
<br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of
<br />notices and same were found sufficient and the Board, therefore, finds that the
<br />several lots and parcels of land have been benefited and damaged in the amounts
<br />shown on said roll. The Board, therefore, decided to take final action on said
<br />assessment roll and the proceedings closed, and the street vacated upon receipt
<br />of the amount of benefit assessments from the various property owners so benefited
<br />and all proceedings had with reference to said street vacation are hereby sustained.
<br />D E D I C A T I O N
<br />WHEREAS, a plat with dedication of streets and alleys indicated thereon is now
<br />y presented to the Board, to be known as Broadmoor, Second Section, an addition to the
<br />City of South Bend, located in Section 30, Township 37 North, Range 3 East.
<br />This plat and dedication is filed in the records of the Board of Public Works
<br />and Safety, and recorded in Book No. , Page No. , in the Recorderts office of
<br />St. Joseph County.
<br />NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the
<br />City of South Bend, Indiana, that all public streets,alleys and public places dedicated
<br />to the public use in said plat are hereby accepted and approved by said Board for
<br />and on behalf of the City of South Bend, Indiana.
