<br />A petition having been filed by Northern Indiana Transit, Inc. which sets forth a
<br />request for change of fares and a showing having been made by said Company,,that the
<br />fares permitted to be charged for bus transportation under a contract made with the
<br />City of South Bend, Indiana on or about the 13th day of May, 1940, and amended by a
<br />contract dated February 13,.1948, and as further amended by a contract dated July 8, 1950
<br />and as further amended by a contract dated March 10, 1952, and a request having been
<br />made by said Company that it be permitted to charge rates for services rendered to the
<br />public which will be fair and reasonable to all parties concerned, and the statutes
<br />of Indiana (Sec. 48-?303 Burns Indiana Statutes, 1950 Repl.) requiring the amendment of
<br />said contract to be undertaken in the manner herein followed, this Board now takes the
<br />following Action:
<br />This Board, in compliance with said Statute, has tentatively determined the exact
<br />form in which the amendment to said contract is to be finally adopted to be in the
<br />following words and figures:
<br />a 0 N T R A C T
<br />THIS CONTRACT, made and entered into this day of 1953, by and between
<br />the CITY OF SOUTH BEND, INDIANA, acting by and th73-ugh its Boar o Public Works and
<br />Safety, hereinafter called the First Party, and NORTHERN INDIANA TRANSIT, INC., a
<br />corporation organized under the laws of the State of Indiana, its successors and assigns,
<br />hereinafter called the Second Party.
<br />WITNESSETH:
<br />The parties hereto agree that the certain contract made between the parties and
<br />confirmed by Ordinance of the Common Council of the City of South Bend, on or about the
<br />13th day of May, 1940, as amended by a contract entered into on the 13th day of February
<br />1948 between the parties and thereafter confirmed by the Common Council, and as further
<br />amended by a contract entered into on the 8th day of July, 1950 between the parties and
<br />thereafter confirmed by the Common Council, and as further amended by contract entered
<br />into on the loth day of March, 1952, and thereafter confirmed by the Common Council, shal
<br />be and is hereby amended in each of the following respects:
<br />All provisions in said contract, as amended, regarding the cash fare of 15, and
<br />token fare of 2 tokens for 25�, and 5� school fare now existing, are amended as follows,
<br />to -wit:

<br />(each token giving a passenger the right to
<br />one ride or trip on a bus).

<br />All provisions in said contract, as amended, regarding transfers, shall remain
<br />the same.
<br />The Second Party shall furnish service to the public over the routes now presently
<br />established.
<br />Said contract made between the parties on the 13th day of May, 1940, as amended
<br />tbythe contract of February 13, 1948, as further amended by contract of July 8, 1950,
<br />d as further amended by contract of March 10, 1952, and as herein above amended, shall
<br />j be and is hereby continued in full force and effect.
<br />Executed in triplicate by the parties on the day first above mentioned.
