525, <br />RESOLUTION NO. 2734 - 1952 Continued <br />BE IT RESOLVED, By the Board of Public Works and Safety of the City of South Bend, <br />Indiana that the Final Estimate and Primary Assessment Roll submitted to the Board by <br />the City Civil Engineer or his duly authorized representative on this loth day of <br />November, 1952 on the improvement known as the FELLOWS STREET LOCAL SEWER as described <br />in Improvement Resolution No. 2734, passed by the Board of Public Works and Safety on <br />August 25, 1952, and confirmed by said Board on September 15, 1952, be and the same is <br />hereby adopted, and the Clerk of this Board is hereby requested to give notice of the <br />hearing of Special Benefits on said Improvement, as required by Section N. 111 or 120 <br />of an Act entitled, 'tAn Act Concerning Municipal Corporations" approved March 6, 1905. <br />R. Crothers <br />Board of Public Works & Safety <br />Clerk of the Board <br />ENGINEERtS CERTIFICATE OF COMPLETION <br />IMPROVEMENT CONTRACT NO.11 - 1952 <br />Certificate of Completion was furnished by civil engineer, Wilbur H. Gartner, <br />accompanied by Contractorts Completion Affidavit of the contract between the City <br />of South Bend, Owner, and,the Rieth-Riley Construction Company, Con tractor, for the <br />construction of the Pavement Improvement -on SHE'RMAN AVENUE from the south line of <br />Rose Street to the North line of Bryan Street, under Improvement Contract Noll <br />has been completed in accordance with the plans and specifications for this project. <br />1 Next appeared before the Board Attorney G. Burt Ford, and his client, P. J. Redden, <br />presenting a drawing showing the exact area to be vacated to the west of Ironwood Drive <br />,on the south bank of the St. Joseph River at the approach to the Ironwood Drive bridge. <br />• Also appearing before the Board at this time was Mr. Vernon C. Hastings, remonstrating <br />!against this vacation and setting forth various reasons for his objection to the vacat- <br />ing of this city -owned property. The matter of some 325 feet of water main being <br />involved, as well as other features of the proposed vacation requiring study, the <br />Board took the entire matter under advisement, decision to be rendered one week from <br />Ithis date. <br />VACATION RESOLUTION No. 2741 - 1952 <br />This being the date set, hearing was had on the resolution heretofore adopted by <br />Ithe Board of Public Works and Safety for the vacation of the FIRST ALLEY NORTH OF FORD <br />FROM WALNUT STREET EAST TO THE WEST LINE OF THE ALLEY EAST OF WALNUT STREET, under <br />• Vacation Resolution No. 2741. <br />i <br />I The Clerk of the Board having shown sufficient proofs of publication and no <br />remonstrators having appeared and no written remonstrances having been filed with the <br />(Clerk, it was moved, seconded and unanimously carried that the said resolution be <br />Mnally adopted and the said alley be vacated. The Engineering Department is directed <br />to prepare an assessment roll covering the assessment of benefits and the award of <br />Idmmages to the surrounding properties. <br />VACATION RESOLUTION NO. 2742 - 1952 <br />I <br />This being the date set, hearing was had on the resolution heretofore adopted by <br />• the Board of Public Works and Safety for the vacation of the following: <br />z Commencing at a point seven feet north of the <br />Southeast corner of Lot No. 30 as shown on the <br />Recorded Plat of Stullts Third Addition to the <br />City of South Bend, Indiana, and on the Westerly <br />line of Main Street; thence West one hundred <br />i sixty-five feet to a point on the Westerly line of <br />Lot No. 30, 'i%rhich is seven feet North of the south- <br />westerly corner of said Lot No. 30; thence North <br />thirty-six feet and two inches to the Northwesterly <br />corner of said Lot No. 30; thence West fourteen feet; <br />• thence South fifty feet and two inches; thence East <br />one hundred sevent-V-nine feet to a point on the west <br />line of Main Street, which is seven feet South of <br />Southeasterly corner of said Lot No. 3O, thence <br />North along the Westerly line of P,.ain Street fourteen <br />feet to the place of beginning, under Vacation <br />Resolution No. 27l�2. <br />The Clerk of the Board having shown sufficient proofs of publication and no <br />remonstrators having appeared and no written remonstrances having been filed with the <br />Clerk, it was moved, seconded and unanimously carried that the said resolution be <br />finally adopted and the said alley be vacated. The Engineering Department is directed <br />to prepare an assessment roll covering the assessment of benefits and the award of <br />damages to the surrounding properties. <br />
