4 4 3 � <br />0 <br />• <br />• <br />• <br />0 <br />• <br />AWARDING CONTRACTS <br />Nos. 2702, 2703, 2709 & 2715 - 1952 <br />The Reed Construction Company, Mishawaka, Indiana was awarded the contracts for <br />the improvements of ILLINOIS STREET from the north line of Western'Avenue to the south <br />line of Washington Street for a Class C Type 1 Cement Concrete Pavement in accordance <br />with improvement Resolution No.'2702 AND <br />ALLEYS BETWEEN DONALD STREET, FOX STREET, DALE AVENUE AND MIAMI STREET for a Class <br />C Type 1 Cement Concrete Pavement in accordance with improvement Resolution No. 2703 <br />AND <br />KLINGER STREET from east line of Michigan Street to the west line of Charles <br />Street for a Class C Type 1 Cement Concrete Pavement in accordance with improvement <br />Resolution No. 2709, AND <br />KENMORE, STREET from the south line of Western Avenue to the north line of Ford <br />Street in accordance with improvement Resolution No. 2715. <br />ENGINEER t S CERTIFICATE OF COMPLETION <br />RE -SURFACE PAVEMENT IMPROVEMENT ON SAMPLE STREET <br />CONTRACT NO.5 <br />The Board received and examined Engineerts Certificate of Completion, this date, <br />of the re -surfacing improvement on Sample Street, between Lincolnway East and <br />Mishawaka Avenue, under Improvement Contract No.5, Reed Construction Company, contractor. <br />Attorneys McGill and Reeder then appeared before the Board in the matter of Vacation <br />Resolution No. 2696. Air. Hurwich informed these gentlemen that the Board had held a <br />conference in the matter and concluded they were being it asked to make a judicial <br />determination as to what constitutes a day, or what constitutes a number of days." <br />The Board did not wish to assume this responsibility and so informed these attorneys, <br />and the assessment roll, as previously presented by the City Engineer, was thereupon <br />finally adopted and the property ordered vacated. <br />John Eherenman next appeared before the Board and was given permission by the <br />Board for the erecting of a fixed canopy at 1013 Portage Avenue, stipulating that it is <br />to be as -shown on blueprints for Job No.5201, drawn by Chester J. Jankowski, Architect, <br />and providing the canopy complies with the required height above the public walk. <br />A petition for the paving of the North and South alley between Ironwood Drive and <br />23rd Street from Wall Street to Mishawaka Avenue, under the Barrett Law Plan was next <br />examined by the Board and ordered referred to the City Engineer for study and report. <br />Permission was granted Robert E. Remley for the continuance of his annual lease of <br />Lot "B" North Sunnyside Addition for the sum of One Dollar (01.00) for the ensuing <br />year. <br />Mr. Rocco Simeri appeared before the Board with the complaint that his property has <br />been damaged and he has been put to considerable expense by the practice of certain <br />persons dumping tin -cans, bottles and other rubbish and throwing stones down upon <br />his premises. Windows in his truck cabs were broken. On questioning Mr. Simeri as to <br />who was causing this damage, the Board ascertained it was mainly a matter of juvenile <br />delinquency and directed Mr. Simeri to report the situation to -Gordon Weist, Juvenile <br />Probation Officer. <br />P!!r. Simeri then reported damage done by the shutting off of six taps, and damage j <br />to sidewalk and curbing, estimated at $1500.00, caused by the operations of the <br />Barna Massa Construction Company in connection with their contract for interceptor <br />sewer construction. Mr. Andrysiak pointed out thatthis contract has been completed, and, <br />that Mr. Simerits only recourse would probably be an attachment proceedings, the facts <br />being, as he (Mr. Simeri) had reported them to the Board. <br />i <br />a <br />A communication addressed to Councilman Chester Muszynski and referred by the <br />Common Council to the Board of Public Works, under -date of May 29th, pertained to <br />reduction of bus service, and was examined and ordered filed. <br />Contractorts Bonds in the amount of $1,000.00 each, were examined and approved by <br />the Board, as follows. <br />Harland Cronk <br />John Eherenman <br />Indiana Bell Telephone Co. (Excavation Bond) <br />Jesse D. Matthews, Inc. <br />The Maintenance Bond of Hartman Builders, Inc., 2816 W. Sample St.,,South Bend, <br />Indiana, in the amount of $3200.00, was examined and approved by the Board. <br />There being no further business, the meeting adjourned at 11:15 A.
