422 ENGINEERING DEPARTMENT This being the time set in our legal advertisement pertaining to bids for the re -surfacing of Sample Street from the east line of Lincolnway East to the south line of Mishawaka Avenue, including the deck of the Sample Street -Bridge, the Board pro- ceeded with this matter, bids being as follows: Rieth-Riley Construction Co. A Non -Collusion Affidavit • South Bend, Indiana with a Surety Bond accompanied this Bid. For the improvement of SAMPLE STREETfromthe east line of Lincolnway East to the south line of Mishawaka Avenue by constructing complete in place a Bituminous Concrete (AH) Re -surface Pavement and Appurtenances all according to plans and specifications. l TOTAL ITEM EXTENSION ------------------------ $16,277.00 i! The bids were taken under advisement and the successful bidder is to be notified early this week. l VACATION RESOLUTION NO.2696 j l This being the date set for the hearing on the assessment roll showing the award of damages and the assessment of benefits in the matter of Vacation Resolution No.2696 I • for the vacation of a portion of COLUMBIA STREET described as follows: ?. 1 l Commencing at a point on the west line of Columbia Street at a point 131.E feet northeasterly at right angles from the northeasterly line of•Lincolnway East, thence south- easterly across Columbia Street on a line projected southeasterly to the east line of said Columbia Street I and which line before projection southeasterly is 134 feet northeasterly at right angles and parallel to the north- +� easterly line of Lincolnway East; thence North along the ;I east line of Columbia Street to the river's edge; thence ;I northwesterly along the river's edge to the west line of Columbia Street; thence south along west line of Columbia Street to place of beginning; said vacation being subject to all easements now existing and inuring to the benefit of Public Utilities operating in the City of South Bend. ; Attorney Warren E. Attorney Leo P. Rieder represented the petitioner, Mr. Otto Gratzol. Both parties 11 • were given ample opportunity to present their case, and it having developed that the �� river bank at this point may not be an actual part of Columbia Street extended, the Ij Board withheld decision in the matter for a period of two weeks, and hearing of the al above resolution is continued to May 5, 1952 at 10:00 A. M. Contractor Bonds of $1,000 each were examined and approved for the following: Joseph Febbo & John Susnjara I James Kovacsics Lawrence W. Weldy Indemnity Bond supplied by the Travelers Indemnity Company for John F. Gohr, d/b/a Niles Excavating Company was examined and approved by the Board. •
