3 8-1 <br />• <br />• <br />0 <br />• <br />• <br />East; thence north along the east line of Columbia <br />Street'to the Riverts edge,• thence'northwesteri.y'along <br />the River's edge to the west line.of Columbia St <br />thencd south along west line of Columbia Ste to place <br />of beginning; said Vacation being subject to all easements <br />now existing and inuring to the benefit of Public <br />Utilities operating the City of South Bend. <br />under vacation resolution No. 2696. <br />In the above named assessment roll, the Board hereby order that it will <br />meet in the City Hall At 11:00 A. M. on the 14th day of January 1952 for the <br />purpose of hearing and receiving remonstrances from all persons interested <br />in or affected by said vacation, and the Board further orders that notice of <br />said hearing, together with the amount of damages awarded and benefits assessed <br />be addressed to the property owners by publishing same on the 4th of January <br />andllth day of January 1952 in the South Bend Daily Tribune and Tri County News. <br />This being the date set, hearing was held on the assessment roll showing <br />the award of damages and' the assessment of benefits in thematter of vacation of <br />A PORTION OF COLUMBIA STREET DESCRIBED AS FOLLOWS: <br />Commencing at a point on the West Line of Columbia Street at a point <br />134 northeasterly at right angles from the northeasterly line of Lincolnway <br />east. Thence southeasterly across Columbia Street on a line projected <br />southeasterly to the east line of said Columbia Street and which line before <br />projection southeasterly is 134 feet northeasterly at right angles and parallel <br />to the northeasterly line of Lincoln way East; thence north along the East <br />line of Columbia Street to the Riverts edge; thence northwesterly along the <br />riverts edge to the west line of Columbia street, thence south along west <br />line of Columbia Street to place of beginning; Said vacation being subject <br />to all easements now existing and inuring to the benefit of public utilities <br />operating in the City of South Bend. Under vacation resolution No. 2696. <br />In the above named assessment roll, no remonstrators appeared and <br />no written remonstrances were. filed, the Clerk of.the Board submitted proofs <br />of publication of notices and' same were found sufficient, and the Board, <br />therefore, finds that the several lots and parcels of land have been bene- <br />fitted and damaged in the amounts shown on said -roll. The Board, therefore, <br />decided to take final action on said assessment roll.and declares same in <br />all things ratified, confirmed and approved without modification. and the <br />proceedings closed, and the portion of the street vacated uppn receipt of <br />the amount of benefit assessments from the various property owners so <br />benefited and all proceedings had with reference to said street vacation <br />are hereby sustained. <br />The time being 12:00 Noon, the meeting was recessed and reconvened <br />at 1:30 P.M. <br />The following four Vacation Resolutions were then acted upon: <br />RESOLVED BY THE BAORD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA: That it is desirable to vacate the following: <br />VACATION RESOLUTION NO.2699 , 1952 <br />WEST VICTORIA STREET FROM MICHIGAN STREET WEST TO THE <br />EAST LINE OF THE NORTH AND SOUTH ALLEY, EXCEPTING THE <br />20 FEET IN THE CENTER, WHICH IS TO BE RESERVED FOR AN <br />ALLEY. <br />The following property may be injuriously or benficially affected by <br />such vacation: <br />Lots Numbered 6 and 7, Stuilts 6th Addition. <br />i <br />Notice of this resolution shall.be published on the 18th day of <br />January and on the 25 day of January 1952 in the South Bend Daily Tribune <br />and Tri County News . <br />This Board, at its office in the City Hall on the 28 day of January <br />1952 at 11:00 A. M. will hear and receive remonstrances from all persons <br />interested in or affected by these proceedings. <br />Adopted this 14th day of January 1952. <br />ATTEST: <br />Ward H.
