In the above named assessment roll, the Board hereby order that it will meet in the City Hall At 11:00 A. M. on the 14th day of January 1952 for the purpose of hearing and receiving remonstrances from all persons interested in or affected by said vacation, and the Board further orders that notice of said hearing, together with the amount of damages awarded and benefits assessed be addressed to the property owners by publishing same on the 4th of January andllth day of January 1952 in the South Bend Daily Tribune and Tri County News. This being the date set, hearing was held on the assessment roll showing the award of damages and' the assessment of benefits in thematter of vacation of A PORTION OF COLUMBIA STREET DESCRIBED AS FOLLOWS: Commencing at a point on the West Line of Columbia Street at a point 134 northeasterly at right angles from the northeasterly line of Lincolnway east. Thence southeasterly across Columbia Street on a line projected southeasterly to the east line of said Columbia Street and which line before projection southeasterly is 134 feet northeasterly at right angles and parallel to the northeasterly line of Lincoln way East; thence north along the East line of Columbia Street to the Riverts edge; thence northwesterly along the riverts edge to the west line of Columbia street, thence south along west line of Columbia Street to place of beginning; Said vacation being subject to all easements now existing and inuring to the benefit of public utilities operating in the City of South Bend. Under vacation resolution No. 2696. In the above named assessment roll, no remonstrators appeared and no written remonstrances were. filed, the Clerk of.the Board submitted proofs of publication of notices and' same were found sufficient, and the Board, therefore, finds that the several lots and parcels of land have been bene- fitted and damaged in the amounts shown on said -roll. The Board, therefore, decided to take final action on said assessment roll.and declares same in all things ratified, confirmed and approved without modification. and the proceedings closed, and the portion of the street vacated uppn receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said street vacation are hereby sustained. The time being 12:00 Noon, the meeting was recessed and reconvened at 1:30 P.M. The following four Vacation Resolutions were then acted upon: RESOLVED BY THE BAORD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA: That it is desirable to vacate the following: VACATION RESOLUTION NO.2699 , 1952 WEST VICTORIA STREET FROM MICHIGAN STREET WEST TO THE EAST LINE OF THE NORTH AND SOUTH ALLEY, EXCEPTING THE 20 FEET IN THE CENTER, WHICH IS TO BE RESERVED FOR AN ALLEY. The following property may be injuriously or benficially affected by such vacation: Lots Numbered 6 and 7, Stuilts 6th Addition. i Notice of this resolution shall.be published on the 18th day of January and on the 25 day of January 1952 in the South Bend Daily Tribune and Tri County News . This Board, at its office in the City Hall on the 28 day of January 1952 at 11:00 A. M. will hear and receive remonstrances from all persons interested in or affected by these proceedings.
