:3 j f � , A letter was received from the City Plan Commission indicating that they recommend the vacation of the alley south of California Avenue from Wilbur Street to Adams Street. The City Engineering Department w4s directed to prepare a vacation resolution for same. VACATION RESOLUTION NO. 2689, 1951 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA: That it is desirable to vacate the following: • °A PART OF KLINGER STREET as shown on the recorded plat of Whitcomb and Keller's Beverly Heights 5th Addition, described as follows: Beginning at a point on the I north line of Klinger Street 50 feet east of the southwest corner of Lot Numbered 120 of said addition; thence easterly on the north line of Klinger Street 122 feet to the southeast corner of Lot Numbered 122 of said addition; thence south 19 degrees, 15 feet east, 12 feet to a point due east of the place of beginning - thence west to,the place of beginning. ' The following property may be injuriously or beneficially effected by such vacation: Lots Numbered 120, 121, and 122, Whitcomb & Keller's Beverly Heights 5th Addition. i i Notice of this resolution shall be published on the 12th day of October and on the 19th day of October, 1951, in the South Bend Daily Tribune and the Tri-County News. i This Board, at its office in the City Hall on the 29th day of October, 1951, at 11:00 I a.m., C.S.T., will hear and receive remonstrances from all persons interested in or af- fected by these proceedings. f Adopted this 8th day of October, 1951, Frank J. Noble, Clerk 2T-12-19 BOARD OF PUBLIC WORKS & SAFETY 1 i VACATION RESOLUTION NO. 2686, 1951 This being the date set, hearing was held on the assessment roll showing the award of damages and the assesment of benefits in the matter of Vacation of FIRST ALLEY VEST OF SCOTT STREET from Lincoln inlay West to the south line of the alley north of Lincolnway West under Vacation Resolution No. 2686. �j In the above named assessment roll, no remonstrators appeared and no written remon- strances were filed, the Clerk of the Board submitted proofs of publication of notices j and same were found sufficient, and the Board, therefore, finds that the several lots j' and parcels of land have been benefited and damaged in the amounts shown on said roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modification and the proceed. ings closed, and the alley vacated upon receipt of the amount of benefit assessments froz the various property owners so benefited and,all proceedings had with reference to said alley vacation are hereby sustained. SEWAGE DISPOSAL: The Board approved Change Order #2 for Contract 3A of the Intercepting Sewer for the Niles Excavating Company for resurfacing North Shore Drive between Angela Boulevard and Parkovash Avenue. • The Board approved Change Order #3 for Contract 2A of the Intercepting Sewer for Thomas D. Nolan, Contractor, for sinking a shaft approximately.300 feet south of the original location in the 54 inch tunnel on Miles Avenue. STREET DEPARTMENT: Melton 0.
