207 VACATION RESOLUTION NO. 2658 I I This being the date set, hearing was had on the resolution heretofore adopted by the; Board of Public Works for the vacation of the alley south of Fredrickson Street from O'Br en Street to the west line of the alley east of O'Brien Street under Vacation Resolutio No. 2658. The Clerk of the Board having shown sufficient proofs of publication and no remon-i strators having appeared and no written remonstrances having been filed with the Clerk, it was moved, seconded and unanimously carried that the said resolution be finally adopt-1 • ed and the said alley,be vacated. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to the sur- rounding properties. VACATION RESOLUTION NO. 2658 Raymond S. Andrysiak, City Engineer, filed primary assessment roll showing the award" of damages and the assessments of benefits in the matter of the vacation of the alley sou ;h (of Fredrickson Street from O'Brien Street to the west line of the alley east of O'Brien Street under Vacation Resolution No. 2658. In the above named assessment roll, the Board hereby orders that it will meet in ti-B11 • City Hall at 11:00 a.m. on the 20th day of November, for the purpose of hearing and receiv- ing remonstrances from all persons interested in or affected by said vacation, and the Board further orders that notice of said hearing, together with the amount of damages a -- warded and benefits assessed be addressed to the property owners by publishing same on t� 3rd day of November and on the 10th day of November, 1950, in the South Bend Daily Tribune. ;and the Weekly Mirror Press. Complaints having been received concerning dirt in the area of the Dan Webster Coal Company, the following letter was drafted; and sent to the coal company: Dear Sir: • Out attention has again been called to the fact that the conditions in your coal yard are highly offensive to your neighbors. Instead of improvements being made, the situation has continued to grow worse. We believe, that at the time you were before the Board several weeks ago, certain commitments were made by you which would correct these conditions. Will you please notify us of what you have done or what steps you intend to take so that this annoy- ance to your neighbors will cease. Kindly notify us within the next ten days as requested above. That he is familiar with and personally knows the requirements of the plans and spe- cifications of said improvement resolution and further knows that the said Reed Construc- tion Company in the performance of said work complied with all the terms and conditions of said plans and specifications in every particular, and that the material used was of the character, kind, quantity and quality required therein and according to and under the direction.of the Board of Public Works and Safety (Signed) Virgil H.
