207 <br />VACATION RESOLUTION NO. 2658 I <br />I <br />This being the date set, hearing was had on the resolution heretofore adopted by the; <br />Board of Public Works for the vacation of the alley south of Fredrickson Street from O'Br en <br />Street to the west line of the alley east of O'Brien Street under Vacation Resolutio No. <br />2658. The Clerk of the Board having shown sufficient proofs of publication and no remon-i <br />strators having appeared and no written remonstrances having been filed with the Clerk, <br />it was moved, seconded and unanimously carried that the said resolution be finally adopt-1 <br />• ed and the said alley,be vacated. The Engineering Department is directed to prepare an <br />assessment roll covering the assessment of benefits and the award of damages to the sur- <br />rounding properties. <br />VACATION RESOLUTION NO. 2658 <br />Raymond S. Andrysiak, City Engineer, filed primary assessment roll showing the award" <br />of damages and the assessments of benefits in the matter of the vacation of the alley sou ;h <br />(of Fredrickson Street from O'Brien Street to the west line of the alley east of O'Brien <br />Street under Vacation Resolution No. 2658. <br />In the above named assessment roll, the Board hereby orders that it will meet in ti-B11 <br />• City Hall at 11:00 a.m. on the 20th day of November, for the purpose of hearing and receiv- <br />ing remonstrances from all persons interested in or affected by said vacation, and the <br />Board further orders that notice of said hearing, together with the amount of damages a -- <br />warded and benefits assessed be addressed to the property owners by publishing same on t� <br />3rd day of November and on the 10th day of November, 1950, in the South Bend Daily Tribune. <br />;and the Weekly Mirror Press. <br />Complaints having been received concerning dirt in the area of the Dan Webster Coal <br />Company, the following letter was drafted; and sent to the coal company: <br />Dear Sir: <br />• Out attention has again been called to the fact that the conditions in your coal <br />yard are highly offensive to your neighbors. Instead of improvements being made, <br />the situation has continued to grow worse. <br />We believe, that at the time you were before the Board several weeks ago, certain <br />commitments were made by you which would correct these conditions. Will you please <br />notify us of what you have done or what steps you intend to take so that this annoy- <br />ance to your neighbors will cease. <br />Kindly notify us within the next ten days as requested above. <br />Very truly yours, <br />• BOARD OF PUBLIC WORKS & SAFETY <br />GAR CONTRACTORS COMPIE TION AFFIDAVIT <br />STATE OF INDIANA ) <br />) SS: <br />ST. JOSEPH COUNTY ) <br />IN THE MATTER relating to the improvement made under Improvement Resolution No. None <br />and the plans and specifications therefor comes now Virgil H. Reed who being duly sworn <br />upon oath deposes and says he is acquainted with the Reed Construction Company the party <br />• to whom was awarded the contract and who performed the work under Improvement Resolution <br />No. North Michigan St., pavement widening. <br />That he is familiar with and personally knows the requirements of the plans and spe- <br />cifications of said improvement resolution and further knows that the said Reed Construc- <br />tion Company in the performance of said work complied with all the terms and conditions <br />of said plans and specifications in every particular, and that the material used was of <br />the character, kind, quantity and quality required therein and according to and under the <br />direction.of the Board of Public Works and Safety <br />(Signed) Virgil H.
