<br />Therefor Be It Resolved, By the Board of Public 1,1orks and Safety of the City of
<br />South Bend, Indiana, that the bids of the Rieth-Riley Construction Company for the cons-
<br />truction of the improvements described in Improvement Resolutions Nos. 2645, 2647 and
<br />2652, 1950, passed by this Board on ijugust 14, 1950, a nd confirmed by this Board on Sep-
<br />tember 5, 1950, be and the same is hereby adopted and that the City of South Bend, India
<br />na, thru its Mayor and Board of Public lilorks and Safety enter into a written contract wi
<br />said Rieth-Riley Construction Company for the faithful executor of such work, according
<br />to said bids, the detailed plans and specifications and the terms of said Resolutions,
<br />provided that before entering upon the performance of said contracts, said Rieth-Riley
<br />Construction Company, shall give bonds, in the amount equal to one hundred (100) er y of the contract price for such. work, with a Surety Company legally authorized to tper ce act business in the State of Indiana, as Surety, to the approval of this Board, to secure
<br />the performance of such contracts, and shall give a lVaintenance Bond in the amount equal
<br />to fifty (50) per cent of the contract price for such work, with a Surety Company legall-, authorized to transact business in the State of Indiana, as Surety, to the approval of
<br />this Board to warrant and quarantee the work, material and condition of the pavements
<br />for a period of three (3) years, and to hold the City of South Bend, Indiana, harmless
<br />from payment of any debt or damage by reason of any.act of such Contractor, and to secur€
<br />the payment of all claims for labor and material used in such improvements.
