<br />ndiana that the bid of the Rieth-Riley Construction Company, South Bend' Indiana

<br />,construction of the improvement described in Improvement Resolution No. 95 for the
<br />by this Board on May 8, 1950, and confianed by -this Board on June 12, 1950 beand ttheasame
<br />lis hereby adopted and that the City of South Bend, Indiana thru its Mayor End Board of
<br />Public Works and Safety enter into a written contract with said Rieth-Riley Construction
<br />Company, South Bend, Indiana for the faithful executor of such work, according to said
<br />;bid, the detailed plans and specifications and the terms of said Resolution, provided
<br />1that before entering upon the performance of said contract, said Rieth-Rile
<br />Company, South Bend, Indiana shall give bond, in the amount equal to one hunConstruction
<br />dred(100)
<br />per cent of the contract price for such work, with a Surety Company legally authorized to
<br />transact business in the State of Indiana, as Surety, to the Epproval of this Board, to
<br />secure the performance of such contract, and shall give a Maintenance Bond in the amount
<br />equal to fifty (50) per cent of the contract price for such work, vd th a Surety Company
<br />Ilegally authorized to transact business in the State of Indiana, as Surety, to the ep pro-
<br />val of this Board to warrant and quarantee the work, material and condition of the pave-
<br />ment for a period of three (3) years, and to hold the City of South Bend, Indiana, harm-
<br />less from payment of any debt or damage by reason of any act of such Contractor, aj:ld to
<br />secure the payment of all claims for labor and material used in such improvement.
