<br />June 16, 1950
<br />A Special Meeting of the Board of Public Works was held on Friday, June 16, 1950 at
<br />`110:00 a.m. .All members were present.
<br />A petition having been filed by Northern Indiana Transit, Inc. which,,s,er ts foth a
<br />;request for change of fares and a showing having been made by said Company; that the fare
<br />• :permitted to be charged for bus transportation under a contract made with the City of South
<br />!Bend, Indiana on or about the 13th day of hay, 1940, as amended by contract'da.ted February
<br />139 1948, and a request having been made by said Company that it be permitted to charge ii
<br />rates for services rendered to the public which will be fair and reasonable to all parties
<br />concerned, and the statutes of Indiana (Sec. 48-7303 Burns Indiana Statutes, 1933) requir-
<br />ling the amendment of said contract to to undertaken in 'the manner herein followed, this
<br />IBoa.rd now takes the following .Action:
<br />This Board, in compliance with said Statute, has tentatively determined the exact r
<br />;form in which the amendment to said contract is to be finally adopted to be in the follow-
<br />ling words and figures:

<br />THIS CONTRACT, made and entered into this day of , 1950, by and between the,:
<br />:CITY OF SOUTH BEND, INDIANA, acting by and through its -Board of Public Works and Safety,
<br />!hereinafter called the First Party, and NORTHERN INDIANA TRANSIT, INC., a corporation or-'
<br />lga.nized'under the laws of the State of Indiana, its successors and assigns, hereinafter
<br />;called the Second Party.

<br />jThe parties hereto agree that the certain contract made between the parties and con-;'
<br />• if by Ordinance of the Common Council of the City of South Bend, on or about the 13th�
<br />dayy of May, 1940, as amended by a contract entered into on the 13th;da.y of February, 19�t8'
<br />between the parties and thereafter confirmed by,the Common Council, shall be and is here8
<br />by amended -in each of the following respects:
<br />All provisions in said contract, as amended, regarding the charges for token fares
<br />�are'hereby deleted. .All provisions in said contract, as amended, as to cash fares and
<br />transfers shall remain the same.
<br />The Second Party shall furnish service to the public over the routes now presently is
<br />established.

<br />Said contract made between the parties on the 13th day of May, 1940, as amended by
<br />the contract of February 13, 1948, as hereinabove amended, shall be and is hereby conti-
<br />hued in full force and effect.
<br />Executed in triplicate by the parties on the day first above mentioned. I'

<br />This Board now fixes the 6th day of July, 1950 at nine o'clock C.S.T. in the fore-
<br />1noon, as the time at which said contract will be finally considered, at the office of this
<br />;Board in the City Hall, 224 North Main Street, South Bend, Indiana. At said time and {;
<br />;place, a public hearing will be had at which any taxpayer may appear and file protest I
<br />against any or all of the provisions of said contract.
<br />IT IS ORDERED that Northern_ Indiana Transit, Inc. shall, at its own expense, cause i
<br />the full and complete text of said contract to be published one time at least one week
<br />before such hearing, with the time and place of such hearing, in the South Bend Tribune, j'
<br />a daily newspaper, and:.the'Mirror- &'.weekly newspaper (there being only one daily newspa,p6r
