<br />Be It Resolved, By the Board of Public Works �2pd Safety of the City of South Bend,
<br />Indiana that it is deemed necessary to improve MCKINLEY AVENUE from the east line of Ed
<br />Street to the west line of Walsh Street, AND
<br />POPLAR STREET from the west line of Cleveland Avenue to the east line of the alley west
<br />of Cleveland Street, AND
<br />THIRTY-FOURTH STREET from the south line of Mishawaka Avenue to the north line of North
<br />Side Boulevard, AND
<br />ALLEY BETWEEN CALVERT STREET AND DONALD STREET from the east line of Scott Street to the
<br />line of Donald Street to the south line of the alley south of Calvert Street, AND west line of Taylor Street; ALLEY BETWEEN SCOTT STREET AND TAYLOR STREET from the north
<br />THIRTY-THIRD STREET from the south line of Mishawaka Avenue to the south line of Pleasan
<br />Street, AND
<br />KENDALL STREET from the north line of Donald Street to the south line of Calvert Street
<br />by constructing a Class "C" Pavement.
<br />The same to be done in accordance with the profiles, drawings, plans, general detail
<br />and specifications of such improvements approved June 12, 1950 and to be adopted by the
<br />Board of Public Works and Safety of the City of South Bend, immediately upon the final
<br />adoption of these resolutions, and placed on file in the office of the City Civil Engin-
<br />eer of Said City, and such improvements are now ordered.
<br />The total cost of said improvements, including all incidental costs such as a.dvertis
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate abut
<br />Ling on said MCKINLEY AVENUE; POPLAR STREET; THIRTY-FOURTH STREET; ALLEY BETWEEN C.ALVERT
<br />AND DONALD STREET, ALLEY BETWEEN SCOTT STREET AND TAYLOR STREET; THIRTY-THIRD STREET; and
<br />KENDALL STREET to be improved, all according to the method and manner provided for in an
<br />.Act of the General Assembly of the State of Indiana, entitled, "An .Act Concerning Munici-
<br />pal Corporations" approved March 6th, 1905, and in accordance with and pursuant to the
<br />provisions of all amendatory and supplemental acts thereto, passed by the General Assembly
<br />of the State of Indiana. Assessments, if deferred, are to be paid in ten equal install-
<br />ments, with interest at the rate of six (6) per cent per annum. (A bond or bonds shall
<br />be issued to the contractor in payment of assessments, as the several owners of real esta
<br />upon which they are a lien exercise the right to pay the same in ten equal installments.)
<br />Under no circumstances shall the City of South Bend, Indiana, be or be hild responsible
<br />for any sum or sums due from said property owner or owners for said work, or for certi-
<br />ficate or certificates, bond or bonds, issued to said contractor in payment for such world
<br />except for such moneys as shall have been actually received by the City from assessments
<br />for such improvements, or such moneys as the City is by said entitled Act and the provi- I
<br />sions of all Acts amendatory and supplemental thereto, required to pay. All proceedings
<br />had and work done in making of said improvements, assements of properties, collection of
<br />assessments and issuance of bonds therefor, shall be as provided for in said entitled Actl
<br />and amendments thereto.
<br />The 6th day of July, 1950 at the hour of 6:30 o'clock P111-CST is hereby fixed as the
<br />time, and the office of the Board in said City as the place, when and where all persons
<br />whose property may be affected by such proposed improvements, may be heard as to the
<br />necessity for the same, and all petitions and remonstrances received and the Board will,
<br />on said day, decide whether the benefits accruing to abutting and adjacent property, and
<br />to the City of South Bend, Indiana, will be equal to or exceed the estimated cost of said
<br />improvements. The Clerk of the Board is hereby ordered to give notice by two weekly pub-
<br />lications, of the time and place of hearingof these resolutions.
