<br />Be it Resolved, By the Board of Public 'Horks and S.:fety of the City of South Bend,
<br />Indiana, that it is deemed necessary to improve 1KTUCKY STREET from 118 feet south of U.
<br />South line of Lincolrnray West to 133 feet south of the south line of Crumstown .Avenue;
<br />and" CRUMSTOvV-N AVENUE from 98 feet blest of the west line of Bendix Drive to the center lir
<br />of Iowa. Street by the construction of a. local sewer, intended and adapted only for local
<br />use by the property holders whose property abuts thereon and not intended or adapted for
<br />receiving sewage from collateral drains, Said settler to be 12 and 10 inches in diameter,
<br />and' said sewer, `nritla all its appurtenances,, shall be constructed in accordance with the
<br />profiles, drawings, plans, general details, and specifications of such improvement approvE
<br />January 23, 1950 and to be adopted by the Board of Public Works and Safety of the City of
<br />South Bend, immediately upon the final adoption of this resolution, and placed on file
<br />in the office of the Board of Public Works and Safety of said City, and such improvement
<br />is now ordered.
<br />The total cost of said improvement, including all incidental costs such as advertis-
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate abut
<br />Ling on said IETUC-�Y STREET end C�?LSTO,i AVEJL�E to be improved, all according to the
<br />method and manner provided for in an .net of the General Assembly of the State of Indiana,
<br />entitled, "An Act Concerning IDnnicipal Corporations" approved. ;-larch 6t h, 1905, and in
<br />accordance with and pursuant to the, provisions of all amendatory and supplemental acts
<br />thereto, passed by the General .Assembly of the State of Indiana. Assessr ents, if defer-
<br />red, are to be paid in ten equal install�ients, with interest at the rate of six (6) per
<br />cent per annum. (A bond or bonds shall be issued to the contractor in payment of assess-
<br />ments, as the several owners of real estate upon which -hey are a lien exercise the right
<br />to pay the same in ten equal installments.) Under no circumstances shall the City of
<br />South Bend, Indiana be or be held responsible for any sum or sur_-s due from said property
<br />owner' or owners for said work, or for the collection of the same, or for the payment of
<br />any certificate or certifi cites, bond or bonds, issued to said contractor in payment for
<br />such ;fork, except for such r__oneys as shall have been actually received by the City from
<br />assessments for such improvement, or such moneys as the City is by said entitled .Act and
<br />the provisions of all Acts amendatory and supplemental thereto, reryuired to pay. All prc
<br />ceedi ngs had and work done in making of said improve-ent, assessment of property, collec-
<br />tion of assessments and issuance of bonds therefor, shall be as provided for in said en-
<br />titled Act and amendments thereto.
<br />i The 15th day of February, 1950 at the hour of 7:30 PM -CST is hereby fixed as the
<br />• time, and the office of tie Board in said City as t'_e place, when and where all persons
<br />;whose property may be affected by such proposed improvement, may be heard, and all peti-
<br />jtions and remonstrances received and the Board twill, on said day, decide whether the be-
<br />nefits accruing to abutting and adjacent r)roperty, and to the City of South. Bend, Indian
<br />will be equal to or exceed the estimated cost of said ir.:provement. And the Clerk of the
<br />Board is hereby ordered to give notice by two wee'_zly publications, of the time and place
<br />!of hearing of this resolution.
