<br /> At 7:06 p.m. Councilmember Karen White made a motion to resolve into the Committee of the
<br /> Whole. Councilmember Dr. David Varner seconded the motion which carried by a voice vote of
<br /> seven(7) ayes. Councilmember Oliver Davis, Vice Chairperson, presiding.
<br /> Councilmember Oliver Davis explained the procedures to be followed for tonight's meeting in
<br /> accordance with Article 1, Section 2-11 of the South Bend Municipal Code.

<br /> 33-17 PUBLIC HEARING ON AN ORDINANCE
<br /> AMENDING THE ZONING ORDINANCE FOR
<br /> PROPERTY LOCATED AT 1709 W.
<br /> LINCOLNWAY, COUNCILMANIC DISTRICT
<br /> NO. 2 IN THE CITY OF SOUTH BEND,
<br /> INDIANA
<br /> Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee, reported that
<br /> they met this afternoon and send this bill forward with no recommendation, due to the fact that
<br /> the presenter was not present for the committee meeting.
<br /> David Stanton, Area Plan Commission, with offices on the 11th Floor of the County-City
<br /> Building, South Bend, IN, served as the presenter of this bill. Mr. Stanton stated, The petitioner
<br /> is requesting a zone change from LB, Local Business District,to CB, Community Business
<br /> District. On site is a vacant vehicle repair establishment. To the north is a vacant home—so, an
<br /> LB, Local Business District—and also, to the east, is a retail establishment which is zoned LB,
<br /> Local Business District. To the south, across Lincoln Way West, is a business zoned LB, Local
<br /> Business District, and then to the south across College is a restaurant zoned MU, Mixed Used
<br /> District. The site plan includes an existing single story building situated at the corner of College
<br /> and Lincoln Way West. The site is fully enclosed by barbed wire fencing. The staff is requiring
<br /> written commitments: one (1), to limit the number of vehicles parked on the site for overnight or
<br /> no more than five (5); and two (2), no barbed wire fencing. This comes to you from the Area
<br /> Plan Commission with a favorable recommendation, subject to the written commitments.
<br /> Rezoning the site to CB, Community Business District, will allow for the reuse of an existing
<br /> commercial structure in a manner consistent with the Comprehensive Plan.
<br /> Councilmember Oliver Davis asked Mr. Stanton, Could you talk about the owner-tenant
<br /> relationship regarding how this is worked out?
<br /> Mr. Stanton asked, So, you're talking about Monarch Industries?
<br /> Councilmember Davis responded, That is correct, sir.
<br /> Mr. Stanton responded, Monarch Industries is actually the owner of this property, but the tenant
<br /> of the property is Mr. David Blake. He is the petitioner and he is here, too, to answer any of
<br /> those questions.
<br /> Councilmember Davis responded, I appreciate that. It would now be nice to hear from Mr. Blake
<br /> and then, after we hear from Mr. Blake about what his intentions are, then we will proceed with
<br /> the asking of Council questions.
<br /> David Blake, 1709 Lincoln Way West, South Bend, IN, served as the petitioner of this bill. Mr.
<br /> Blake stated, I'd just like to open up a small car repair establishment, there, and hopefully save
<br /> people in the community some money. Basically, I'm retired, so this will give me something to
<br /> do. I'd really like to save some of the people in the community some money based on what I see
<br /> going on when it comes to repairing automobiles. I honestly don't think it takes what all these
<br /> people are charging people for working on cars.
<br /> Councilmember Davis asked, You've been there before? You've been in this location before or
<br /> something? Can you tell us about that?
