<br />(A bond or bonds shall be issued to the contractor in payment of assessments, as the sev-
<br />eral owners of real estate upon which they are a lien exercise the right to pay the
<br />same in ten equal installments.) ,Under no circumstances shall the City of South Bend,
<br />Indiana be or be held responsible for any sum or sums due from said property owner or
<br />owners for said work, or for certificate or certificates, bond or bonds, issued to said
<br />contractor in payment for such work, except for such moneys as shall have been actually
<br />received by the City fror_i assessr.ent for such improvement, or such moneys as the City is
<br />by said entitled Act and the provisions of all Acts amendatory and supplemental t_iereto,
<br />required to pay. All proceedings had and work done in making of said improvement, assess
<br />ment of propertycollection of assessments and issuance of bonds therefore, shall be
<br />as provided for in said entitled Act and amendments thereto.
<br />September 241 1948 at the hour of 7:30 P.P . O'clock, C.D.T. is hereby fixed a,s the
<br />time, and the 0-J f ice of the Board in said City as the place, �,rhen and where all persons
<br />whose property may be affected by such proposed improve cnt, may be heard as to the
<br />necessity for the same, and all petitions and remonstrances received and the Board will,
<br />on said day, decide whether the benefits accruing to abutting and adjacent property,
<br />and to the City of South Bend, ini_iana, will be equal to or exceed the estimated cost of
<br />said improvement. And the Clerk of the •oa.rd is herel yr ordered to give notice by two
<br />weekly publications, of the time and place of hearing of this resolution.
