<br />Be` It Resolved, By the Board of Public Works and Safety of the City of South Bend, Indiana,
<br />that it is deemed necessary to improve Twenty-fifth (25th) Street from north line of
<br />of Mishai.,raka Avenue to South property line of lott "A" & "B" in Hastings, Woodward , &
<br />Gray Addition by draining, grading and paving the'roadtiray with a Class "C" pavement as
<br />follows: Type 1 -'Portland Cement Concrete; Type`2 - Bituminous Compacted Aggregate Base
<br />Bituminous Concrete Surface; Type.3 - Bituminous Compacted Aggregate Base, Bituminous
<br />Coated Aggregate Surface; Type 4 - Compacted Aggregate Base, Bituminous Concrete Surface;
<br />Type 5 - Compacted Aggregate Base, Bituminous Coated Aggregated Surface. The same to be
<br />done in accordance with the profiles, drawings, plans, general details and specifications
<br />of'such improvement approved August 9, 1948 and to be adopted by the Board of Public Works
<br />and Safety of the City of South Bend, immediately'upon the final adoption of this resol-
<br />ution, and placed on file in the office of the City Civil Engineer of°sa.id City, and sue

<br />improvement is now ordered.
<br />The total cost of said improvement, including all incidental' costs such as adver-
<br />Using, abstracting, inspection and engineering, Shall be assessed upon the real estate
<br />abutting on said Twenty-fifth (25th) Street to be improved, all according to the method
<br />and manner provided for in an Act of the General Assembly of the State of Indiana, entit-
<br />led "An Act Concerning Iiunicipal_..Corporations" approved March 6,'19051 and in accordance
<br />with and pursuant to the provisions of all amendatory and supplemental acts thereto,
<br />passed by the General Assembly of the State of Indiana. Assessnents, if deferred, are to
<br />be paid in ten equal installments with interest at the rate of five (5) per cent per
<br />annum. (A bond or bonds shall be issued to the contractor in payment of a.ssessraents, as
<br />the several owners of real estate upon which they are a lien exercise the right to pay
<br />the same in ten equal installments.) Under no circumstances shall the City of South Bend
<br />Indiana, be or be held responsible for any sum or sums due from said property oiT or
<br />owners for said work, or for certificate or certificates, bond or bonds, issued to said
<br />contractor in payment for such work, except for such moneys as shall have been actually
<br />received by the City from assessment for such improvement, or such moneys as the City is
<br />by said entitled Act and the provisions of all Acts amendatory and supplemental thereto,
<br />required to pay. All proceedings had and work done in making of said improvemen, assess-
<br />ment of property, collection of assessnier_ts and issuance of bonds therefor, shall be as
<br />provided for in said entitled Act and amendments thereto.
<br />Thursday, September 2, at the hour of 7:30.o'clock P.ii. (CDT) is hereby fixed as the
<br />time and the office of the Board in said City as the place, when and where all persons
<br />whose property may be affected by such proposed i_riprovernent, may be heard a.sl,to the nec-
<br />essity for the same, and all petitions and remonstrances received and the Board will, on
<br />said day,decide whether the benefits accruing to abutting and adjacent property, and
<br />to the ty of South Lend, Indiana, will be cqua.l to or exceed the estiriated cost ' of said
<br />improvement. And the Clerk of the Board is hereby ordered to give notice by two weekly
<br />publications, of the time and place of 'nearing of this resolution.
