<br />Be It Resolved, By the Board of Public Works and Safety of the City. of (I
<br />South Bend, Indiana, that it is deemed necessary to improve South_'Kosciuszko Street from 11
<br />Pyorth line of Sample Street to South line of Dunham Street by draining, grading and pavin
<br />the roadway with a Class "C" pavement as follows: Type 1 - Portland Cement Concrete;
<br />Type 2 - Bituminous Compacted _Aggregate Base, BitLuninoes Concrete Surface; Type 3 -
<br />Bituminous Compacted Aggregate Base, Bituminous Coated Aggregate Surface; Type - Compacted
<br />Aggregate Base, Bituminous concrete Surface; Type 5 - Compacted Aggregate Base, Bitumin- 11
<br />ous Coated Aggregate Surface The same to be done in accordance with the profiles, draw !i
<br />11
<br />ings, plans, general details and specifications of such improvement adopted August 9, 11
<br />10,48 and to be adopted by the Board of Public Works and Sa'�ety of the City of South Bend, i1
<br />immediately upon the final adoption of this resolution, and placed on file in the office
<br />of the City Civil Emgineer of said City, and such improver,,ent is now ordered.
<br />The total cost of said improvement, includingall incidental costs such as advertis-
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate
<br />abutting on said South Kosciuszko Street to be improved, all according to the method and
<br />manner provided for in an Act of the General Assembly of the State of Indiana, entitled,
<br />'!An Act Concerning Municipal Corporations" approved -arch 6, 1905, and in accordance with
<br />and pursuant to the provisions of all amendatory and su_pplemental acts thereto, passed
<br />by the General Assembly of the State of Indiana. Assesmients, if deferred, are to be
<br />paid in ten equal installments with interest at the rate of five (5) per cent per annum.
<br />(A bond or bonds shall be issued to the contractor in payment of assessments, as the
<br />several downers of real estate upon whichthey are a lien exercise the right to -oay the
<br />same in ten equal installments.) Under no circumstances shah_ the City of South Bend,
<br />Indiana, be or be held responsible for any suri or sums due from said property owner or
<br />o;mers for said work, or for certificate or certificates, bond or bonds, _issued to said
<br />contractor in payment for such work, except for such moneys as shall have been actually
<br />received by the City frog: assessment for such irlprovernent, or such moneys as the City is
<br />by said entitled act and the provisions of all Lcts amendatory and supplemental thereto,
<br />required to pay. All proceedings had.and work done in raking of said i.-Tprovenient, assess
<br />ment of property, collection of assessments and issuance of bonds therefor, shall be as
<br />provided for in said entitled Act and amendments thereto.
<br />Thursday, September 21 1948 at the hour of 7:30 o'clock P.i_. (CDT) is hereby fixed
<br />as the time, and the office of the Board in said City as the place, when and 'there all
<br />persons whose property may 'e affected by such proposed improvement, may be heard as to
<br />the necessity for the same, and all petitions and remonstrances received and the Board
<br />will, on said day, decide whether the benefits accruing to abutting property and adjacent
<br />property, and to the City of South Bend, Indiana, will be equal to or exceed the estimate
<br />cost of said improvement. And the Clerk of the Board is hereby ordered to give notice by
<br />two weekly publications, of the time and place of searing of this resolution.

<br />Estimates and Preliminary Improvement Resolution for the improvement of Twenty-fifth
<br />(25th) Street from North line of Mishawaka Avenue to South property line of lots "A" ec
<br />"B" in basting, Woodward & Gray Addition by draining, grading and paving with a Class
<br />"C" pavement.
