SUPPLEMENTAL AGREEMENT NO. 1 This Supplemental Agreement No. 1 is made and entered into this N day of dC'N, 20 by and between the City of South Bend, Indiana, acting by and through the Board of Public Works, hereinafter referred to as the "Owner", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN 46615, hereinafter referred to as the "Engineer". WITNESSETH WHEREAS, the Owner and Engineer did, on February 28, 2017 enter into an agreement for the preparation of construction documents for the construction of the Colfax Avenue Two -Way Conversion. WHEREAS, during the course of design, certain additional services not included in the original contract dated February 28, 2017, have become necessary; specifically: • Additional topographic survey at the intersection of Colfax Avenue and LaPorte Avenue. • Design of bumpouts along the curb in each of the four approaches of the Colfax Avenue and LaPorte Avenue Intersection. • Alignment and parking lot study for LaSalle Avenue NOW THEREFORE, the Owner and the Engineer desire to amend the above referenced Design Contract as follows: I. Delete Exhibit A.I. and replace with the attached exhibit: (Exhibit A.1. has been revised to show the additional topographic survey limits required to design bumpouts at the intersection of Colfax Avenue and LaPorte Avenue. The survey shall extend for a distance of 150 feet from the center of the intersection along each of the four approaches). II. Delete item A 2 d from Section Al 02 in Exhibit A in its entirety and replace with the following d. Traffic Signal Removal 1) The Engineer shall design the installation of stop signs at the intersection of Colfax Avenue with LaPorte Avenue using Owner's standards. Specifications for use in bidding and an opinion of probable construction cost shall be prepared. it is assumed that no lane additions or roadway widening will be required to accommodate two-way traffic or turn lanes. III. Add Sub -Section A.13. to Section A1.02 of Exhibit A as follows: 13. Intersection Improvement of Colfax Avenue and LaPorte Avenue including (See Exhibit A.1. j: a. The Engineer shall develop a conceptual plan for adding bumpouts in each of the four quadrants of the intersection, including sidewalk and pavement marking modifications.
