REGULAR MEETING AUGUST 22, 2017 255 PUBLIC HEARING — NEW MASSAGE ESTABLISHMENT LICENSE — MAINSTAGE MASSAGE Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a license for Mainstage Massage. It was noted favorable recommendations were received from the Fire Department, Building Department, and Police Department. There being no one else present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the application for a license was approved. TABLED - PUBLIC HEARING — NEW MASSAGE ESTABLISHMENT LICENSE — COUNCIL OAK MASSAGE THERAPY, LLC Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a license for Council Oak Massage Therapy, LLC. It was noted unfavorable recommendations were received from the Police Department. Mr. Gilot stated Patrolman Burns recommends denial on behalf of the Police Department due to pending litigation against individuals involved in the establishment. David Wemhoff, Attorney, and Tim Kalamaros, Attorney, were both present on behalf of Council Oak Massage Therapy, LLC. They requested approval and said they do not know the nature of the Police Department's comments. Mr. Kalamaros stated the principals are in good standing and have complied with all requirements for the license. Mr. Schmidt, Legal, advised there is a similar operation in Osceola that is linked to the applicants and there is potential investigation there. He stated the applicant did not advise the Board of these allegations when they submitted their application which makes the application inaccurate for the Board to take action on and recommended the Board table this request until further information is received. Mr. Wemhoff and Mr. Kalamaros stated the application does not require to list any potential investigations, only convictions, which there aren't any yet. Mr. Kalamaros stated this is a City of South Bend license application and what happened in Osceola is not in South Bend's jurisdiction. Mr. Gilot intervened and stated he has been a Board member between two (2) cities for over thirty (30) years and requested the application be tabled until additional information is received from Legal and Police and that he is unready to act on this today. There being no one else present wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the application for a license was tabled. OPENING OF BIDS — ONE (1) OR MORE 2017 OR NEWER SINGLE AXLE DUMP TRUCK WITH UNDERBODY SCRAPER — SPEC W (VENUES PARKS AND ARTS CAPITAL LEASE) This was the date set for receiving and opening of sealed bids for the above referenced project. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- County News, which were found to be sufficient. The following bids were opened and publicly read: SELKING INTERNATIONAL 4849 W. Western Avenue South Bend, IN 46619 Bid was signed by: Kenneth Waite Contractor's Non -Collusion Affidavit, Non -Debarment Affidavit, Certification Regarding Investment with Iran, Employment Eligibility Verification, Non -Discrimination Commitment for Contractors and Certification of Use of United States Steel Products or Foundry Products was submitted.
