REGULAR MEETING AUGUST 22, 2017 255 <br />PUBLIC HEARING — NEW MASSAGE ESTABLISHMENT LICENSE — MAINSTAGE <br />MASSAGE <br />Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a license <br />for Mainstage Massage. It was noted favorable recommendations were received from the Fire <br />Department, Building Department, and Police Department. There being no one else present <br />wishing to address the Board concerning this matter, the Public Hearing was closed. Therefore, <br />upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the application for a <br />license was approved. <br />TABLED - PUBLIC HEARING — NEW MASSAGE ESTABLISHMENT LICENSE — <br />COUNCIL OAK MASSAGE THERAPY, LLC <br />Mr. Gilot advised that this was the date set for the Board's Public Hearing concerning a license <br />for Council Oak Massage Therapy, LLC. It was noted unfavorable recommendations were <br />received from the Police Department. Mr. Gilot stated Patrolman Burns recommends denial on <br />behalf of the Police Department due to pending litigation against individuals involved in the <br />establishment. David Wemhoff, Attorney, and Tim Kalamaros, Attorney, were both present on <br />behalf of Council Oak Massage Therapy, LLC. They requested approval and said they do not <br />know the nature of the Police Department's comments. Mr. Kalamaros stated the principals are <br />in good standing and have complied with all requirements for the license. Mr. Schmidt, Legal, <br />advised there is a similar operation in Osceola that is linked to the applicants and there is <br />potential investigation there. He stated the applicant did not advise the Board of these allegations <br />when they submitted their application which makes the application inaccurate for the Board to <br />take action on and recommended the Board table this request until further information is <br />received. Mr. Wemhoff and Mr. Kalamaros stated the application does not require to list any <br />potential investigations, only convictions, which there aren't any yet. Mr. Kalamaros stated this <br />is a City of South Bend license application and what happened in Osceola is not in South Bend's <br />jurisdiction. Mr. Gilot intervened and stated he has been a Board member between two (2) cities <br />for over thirty (30) years and requested the application be tabled until additional information is <br />received from Legal and Police and that he is unready to act on this today. There being no one <br />else present wishing to address the Board concerning this matter, the Public Hearing was closed. <br />Therefore, upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the <br />application for a license was tabled. <br />OPENING OF BIDS — ONE (1) OR MORE 2017 OR NEWER SINGLE AXLE DUMP <br />TRUCK WITH UNDERBODY SCRAPER — SPEC W (VENUES PARKS AND ARTS <br />CAPITAL LEASE) <br />This was the date set for receiving and opening of sealed bids for the above referenced project. <br />The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- <br />County News, which were found to be sufficient. The following bids were opened and publicly <br />read: <br />SELKING INTERNATIONAL <br />4849 W.
