Engineering noted there are several other access points. The Fire Department stated the vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient and hinder the public's access to a church, or school or other public building or place and the Fire Department would not be able to access the water supply to the church. Mr. Gilot stated violating even one of the four (4) criteria is grounds for an unfavorable recommendations. Therefore, Ms. Maradik made a motion for an unfavorable recommendation of the request for vacation. Ms. Dorau seconded the motion which carried. APPROVE TRAFFIC CONTROL DEVICES Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following traffic control devices were approved: NEW INSTALLATION: Lincoln Highway Historic Byway Signs LOCATIONS: Lincolnway East near Eddy St. Michigan St. at Monroe St. Intersection Michigan St. at Western Ave. Intersection Martin Luther King Jr. Blvd. and Western Ave. Intersection Michigan St. at Washington St. Intersection Washington St. at Lafayette Blvd. Intersection Lafayette Blvd. at LaSalle Ave. Intersection REMARKS: All criteria has been met REVISION: Parking Spot Designations LOCATION: South Side Parking Spots on East Bound Lane of Jefferson Blvd., East of Lafayette Blvd. DESCRIPTION: Parking Spot 1: Change from No Parking to City -Owned Electric Vehicle Parking Only; Parking Spot 2: Change from Public 1-Hour Parking to Public 2 Hour Electric Vehicle Parking Only REMARKS: All criteria has been met APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE — 18275 FOREST GLADE DRIVE & 18391 FOREST GLADE DRIVE — SEWER/WATER Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Century Builders, 314 Catalpa, Suite F, Mishawaka, IN 46545. The Consent indicates that in consideration for permission to tap into public water/sanitary sewer system of the City, to provide water/sanitary sewer service to the above referenced properties at 18275 Forest Glade Drive (Key # 002-1014-027393) and 18391 Forest Glade Drive (Key #002- 1014-027399), Century Builders waive(s) and release(s) any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Ms. Maradik made a motion that the Consent be approved. Ms. Dorau seconded the motion, which carried. RATIFY APPROVAL AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS Ms. Donna Hanson, Division of Engineering, recommended that the following Contractor Bond be released as follows: Business Bond Type Approved/ Released Effective Date Holladay Construction Group Contractor Released August 14, 2017 Ms. Maradik made a motion that the bond release as outlined above be ratified. Ms. Dorau seconded the motion, which carried.
