REGULAR MEETING AUGUST 22, 2017 271 <br />is contiguous. Community Investment stated the vacation would also hinder the public's access <br />to a church, school or other public building or place. Engineering noted there are several other <br />access points. The Fire Department stated the vacation would make access to the lands of the <br />aggrieved person by means of public way difficult or inconvenient and hinder the public's access <br />to a church, or school or other public building or place and the Fire Department would not be <br />able to access the water supply to the church. Mr. Gilot stated violating even one of the four (4) <br />criteria is grounds for an unfavorable recommendations. Therefore, Ms. Maradik made a motion <br />for an unfavorable recommendation of the request for vacation. Ms. Dorau seconded the motion <br />which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: Lincoln Highway Historic Byway Signs <br />LOCATIONS: Lincolnway East near Eddy St. <br />Michigan St. at Monroe St. Intersection <br />Michigan St. at Western Ave. Intersection <br />Martin Luther King Jr. Blvd. and Western Ave. Intersection <br />Michigan St. at Washington St. Intersection <br />Washington St. at Lafayette Blvd. Intersection <br />Lafayette Blvd. at LaSalle Ave. Intersection <br />REMARKS: All criteria has been met <br />REVISION: Parking Spot Designations <br />LOCATION: South Side Parking Spots on East Bound Lane of Jefferson <br />Blvd., East of Lafayette Blvd. <br />DESCRIPTION: Parking Spot 1: Change from No Parking to City -Owned <br />Electric Vehicle Parking Only; Parking Spot 2: Change <br />from Public 1-Hour Parking to Public 2 Hour Electric <br />Vehicle Parking Only <br />REMARKS: All criteria has been met <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE — 18275 FOREST GLADE DRIVE & 18391 FOREST GLADE DRIVE — <br />SEWER/WATER <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Century Builders, 314 Catalpa, Suite F, Mishawaka, IN 46545. <br />The Consent indicates that in consideration for permission to tap into public water/sanitary sewer <br />system of the City, to provide water/sanitary sewer service to the above referenced properties at <br />18275 Forest Glade Drive (Key # 002-1014-027393) and 18391 Forest Glade Drive (Key #002- <br />1014-027399), Century Builders waive(s) and release(s) any and all right to remonstrate against <br />or oppose any pending or future annexation of the property by the City of South Bend. <br />Therefore, Ms. Maradik made a motion that the Consent be approved. Ms. Dorau seconded the <br />motion, which carried. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Ms. Donna Hanson, Division of Engineering, recommended that the following Contractor Bond <br />be released as follows: <br />Business <br />Bond Type <br />Approved/ <br />Released <br />Effective Date <br />Holladay Construction Group <br />Contractor <br />Released <br />August 14, 2017 <br />Ms. Maradik made a motion that the bond release as outlined above be ratified. Ms. Dorau <br />seconded the motion, which carried. <br />APPROVE CLAIMS <br />Mr. Gilot stated that a request to pay the following claims in the amounts indicated has been <br />received by the Board; each claim is fully supported by an invoice; the person receiving the <br />1 <br />1 <br />I <br />
