REGULAR MEETING JULY 25, 2017 230 <br />1 <br />I <br />Inc <br />Riding for a <br />Lift <br />TABLE/APPROVE PARTIAL TEMPORARY OCCUPANCY PERMIT — 321 SOUTH MAIN <br />STREET <br />Ms. Donna Hanson, Engineering Department, submitted an application for Temporary <br />Occupancy at 321 S. Main Street on behalf of Majority Builders, Inc., to close the full sidewalk <br />and west alley from July 10, 2017 to July 10, 2018 for construction on the Hibberd Building. The <br />Board agreed a one (1) year closing of the sidewalk was excessive, and an inconvenience. Ms. <br />Maradik noted the drawing showed the north alley closed in addition to the west alley and <br />suggested that was needed to be open for trash pickup. She noted also the cycle path was part of <br />the closure and that would be needed the following week. The Board agreed the sidewalk was <br />wide enough that that lane shouldn't need to be included. Mr. Gilot suggested the contractor be <br />contacted and asked to narrow down the time and asked to leave the cycle path open. Mr. Eric <br />Horvath, Public Works, suggested the Board approve a temporary permit of two (2) weeks to a <br />month until the questions could be answered. Mr. Gilot asked the Board table the request and ask <br />the contractor to come to the next meeting to explain why they needed a full year and full <br />sidewalk. Mr. Mueller made a motion to approve a temporary permit as shown, through August <br />8, 2017. Ms. Maradik seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH/SOUTH <br />ALLEY FROM LINDEN ST. TO HINE ST. WEST OF PAGIN ST., EAST OF STUDEBAKER <br />ST. <br />Mr. Gilot indicated that Carolyn Peppers, 328 Linden Ave., South Bend, IN 46628, has <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Solid Waste <br />Department. Area Plan stated the vacation would not hinder the growth or orderly development <br />of the unit or neighborhood in which it is located or to which it is contiguous. The vacation <br />would not hinder the public's access to a church, school or other public building or place. The <br />vacation would not hinder the use of a public right-of-way by the neighborhood in which it is <br />located or to which it is contiguous. Mr. Gilot advised the Board is in receipt of unfavorable <br />recommendations concerning this Vacation Petition from the Area Plan Commission, Fire <br />Department, Community Investment, and Engineering Departments because the vacation would <br />make access to the lands of the aggrieved person by means of public way difficult or <br />inconvenient, noting there is garage access for several garages on this alley. Therefore, Ms. <br />Maradik made a motion for an unfavorable recommendation of the request for vacation. Ms. <br />Dorau seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 1614 S. Taylor St. <br />133 E. Ewing Ave. <br />REMARKS: All criteria has been met <br />REMOVAL INSTALLATION AND REVISIONS: <br />LOCATION: South Side of Jefferson Blvd. between Michigan St. and <br />Dr. Martin Luther King Jr. Blvd.; remove Half -Hour <br />Parking Restriction, install Two -Hour Parking on this <br />Block and No Parking in Spaces on either side of <br />Mailboxes and Fire Hydrants, adjust Locations of No <br />Parking Restrictions to align with newly marked Spaces <br />REMARKS: All criteria has been met <br />REVISION: <br />LOCATION: LaPorte and Colfax Ave. Intersection; convert Traffic <br />Signal to all Red Flashing for a period of at least Ninety <br />(90) Days based on Traffic Signal Warrant Study <br />recommending removal of the Traffic Signal <br />
