Staff Report <br />The petitioner is seeking the following variance(s): <br />3/8/2017 <br />1) from the minimum 30 ft. Front Residential Bufferyard and 20 ft. Side Residential <br />Bufferyard to 5' for parking <br />2) from the required landscaping of required residential bufferyards with Type "B" <br />Landscaping to allow 6 ft. high solid screening fence on the south and a 6 ft. high chain <br />link fence on the west <br />3) from the required landscaping of required perimeter yards to none <br />4) from the required foundation landscaping to none <br />5) from the minimum allowed parking aisle width of 24 ft. to a minimum of 22 ft. <br />6) from the required minimum of 380 parking spaces for the proposed Event Center to a <br />minimum of 110 parking spaces <br />7) from the required 1 loading space for buildings containing 10,000 sq.ft. but less than <br />100,00 sq.ft. to providing no loading space <br />8) from the required parking area screening to none <br />State statutes and the Zoning Ordinance require that certain standards must be met <br />before a variance can be approved. The standards and their justifications are as follows: <br />(1) The approval will not be injurious to the public health, safety, morals and general <br />welfare of the community; <br />The proposed development variances should have no impact on the public health, safety, <br />and general welfare of the community. <br />(2) The use and value of the area adjacent to the property included in the variance <br />will not be affected in a substantially adverse manner; <br />The use and value of adjacent properties should not be adversly affected by the requested <br />variances. The redevelopment of this site will allow for additional parking, improved <br />landscaping, and increased screening from the previous industrial use. <br />(3) The strict application of the terms of this Chapter would result in practical <br />difficulties in the use of the property <br />Strick application of the ordinance would require either a portion of the building to be <br />demolished or additional land acquired to accommodate the parking, setbacks, and <br />associated screening. The site is bounded by a railraod on the north, a municipal retention <br />basin on the west, an alley and single family homes on the south, and an active industrial <br />business on the east. <br />Staff Comments: <br />The staff has no additional comments. <br />Recommendation: <br />Based on information available prior to the public hearing, the staff recommends the <br />rezoning petition be sent to the Common Council with a favorable recommendation. The <br />staff recommends approval of the variances, subject to installing a minimum 6' solid wood <br />or vinyl fence along the south property line. <br />APC # 2813 -17 Page 3 of 4 <br />
